Vietnam: What is the responsibility of the police in handling road traffic accidents?

On June 01, 2020, the Ministry of Public Security submitted the Draft Law on ensuring road traffic order and safety to the National Assembly of Vietnam for consideration. This Draft Law has stipulated the responsibilities of the police branch in dealing with traffic accidents.

Specifically, according to Article 72 the Draft Law on ensuring road traffic order and safety of Vietnam, responsibilities of the police branch in dealing with traffic accidents are specified as follows:

1. Receive and process traffic accident reports; send people to the scene to coordinate with agencies, organizations, individuals and local People's Committees in organizing rescue, protecting the scene, ensuring smooth and safe traffic and inspecting alcohol and drug concentrations of vehicle operators present at the scene.

2. Conduct investigation, verification and settlement of traffic accidents according to the provisions of law. Concluding the cause of the traffic accident must have enough directly related factors (vehicle drivers; vehicle technical safety; traffic infrastructure, unexpected factors). Organize the conciliation parties to compensate for property damage caused by traffic accidents or guide the civil court in case the parties cannot reconcile themselves.

3. Organize the verification and tracing of vehicles and drivers that fled the scene or were temporarily relocated from the scene.

4. Organize a re-examination of the Law on assurance of traffic order and safety for all cases of traffic accidents after the period of having their driving license revoked or the period of being banned from practicing vehicle operation.

5. Statistics and synthesis of traffic accidents; assume the prime responsibility for, and coordinate with relevant agencies and departments in, building a database system on traffic accidents (statistics on traffic deaths are 30 days).

6. Provide authentic information about traffic accidents to competent authorities upon request; periodically provide traffic accident situations and data to the authorities.
