Vietnam: 31 prohibited acts specified in the Draft Law on ensuring road traffic order and safety

Currently, the Draft Law on ensuring road traffic order and safety is being submitted by the Ministry of Public Security to the Government of Vietnam for consideration.

Notably, there are 31 prohibited acts specified in the Draft Law on ensuring road traffic order and safety. To be specific:

1. Operating a vehicle in road traffic with drugs or other stimulants in the body that are prohibited by law.

2. Operating a vehicle participating in road traffic with alcohol content in blood or breath.

3. Operating a motor vehicle without a driver's license as prescribed. Operating a special-use motorcycle participating in road traffic without a certificate of training in road traffic law knowledge, a license or a certificate for operating special-use motorbikes.

4. Operating a motor vehicle exceeding the prescribed speed; go to the wrong part of the road or lane; avoid or overtake the wrong lane.

5. Operating vehicles in the opposite direction, making U-turns, reversing on highways and in road tunnels, except for priority vehicles that are on urgent duty as prescribed.

6. Operating motorcycles, mopeds (including electric scooters), motorcycle-like vehicles and motorcycle-like vehicles on highways, except for vehicles serving the management, highway maintenance.

7. Operating a car for transport business for more than 4 consecutive hours and more than 10 hours in a day.

8. Continuously honking, revving up the engine; honking from 10 pm to 5 am, using the high beam in the urban area or residential area, except for emergency vehicles on duty as specified in this Law.

9. Racing, cheering for car racing, organizing illegal racing, swerving, swinging.

10. Running away after causing an accident to avoid responsibility.

11. Transporting goods banned from circulation, illegally transporting or failing to fully comply with regulations on transportation of dangerous goods and wild animals.

12. Using a mobile phone by hand when driving a vehicle in traffic.

13. Handing over motor vehicles and special-use motorbikes to people who are not qualified to operate vehicles participating in road traffic.

14. Installing and using horns and lights not in accordance with the manufacturer's design for each type of motor vehicle; using audio equipment to cause disturbance to traffic safety and public order; mounting motor vehicle license plates in the wrong position or covering or gluing all or part of license plates when participating in traffic.

15. Arbitrarily cutting, welding, re-punching the frame number and machine number; bringing vehicles that have been cut, welded, or re-punched to the frame number and engine number contrary to the regulations to join the traffic.

16. Erasing, repairing or forging vehicle registration records.

17. Arbitrarily changing the frame, engine, shape, size and characteristics of the vehicle.

18. Making false declarations or using fake papers and documents to be re-issued with license plates and vehicle registration papers.

19. Bringing motorized road vehicles without vehicle registration papers to participate in traffic or have them but have expired.

20. Bringing road motorized vehicles that fail to meet technical safety and environmental protection standards to participate in road traffic.

21. Placing, leaving unauthorized obstacles on the road; throwing nails, spreading nails or other sharp objects, pouring lubricants or other slippery substances on the roadway; putting ropes or other obstacles across the road causing danger to people and vehicles participating in traffic.

22. Throwing bricks, soil, stones, sand or other objects at vehicles participating in traffic on the road.

23. Illegally using roadbeds, curbs and sidewalks; Illegal gatherings of people obstructing traffic.

24. Obstructing or failing to comply with inspection and control requests of official duty enforcers.

25. Changing, deleting traces of traffic accident scenes.

26. Illegally producing, using, buying and selling license plates of motor vehicles and special-use motorcycles (except for the case of buying and selling winning license plates at auction).

27. When there are conditions, but intentionally do not help people suffering from traffic accidents.

28. Infringing upon the life, health and property of the victim and the person causing the accident.

29. Taking advantage of the occurrence of a traffic accident to assault, threaten, instigate, put pressure on, cause disorder, or obstruct the handling of traffic accidents.

30. Abusing one's own or another's position, power or profession to violate the law on road traffic.

31. Acts of violating road traffic rules, other acts causing danger to people and vehicles participating in road traffic.
