In Circular 69/2024/TT-BCA, the Ministry of Public Security of Vietnam has provided guidance on resolving the audio and video recording of traffic police on duty, effective from the year 2025.

On November 12, 2024, the Minister of Public Security of Vietnam issued Circular 69/2024/TT-BCA, stipulating the command and control of road traffic by Traffic Police; including guidance on resolving issues related to the audio and video recording of traffic police officers on duty starting from January 01, 2025.
Drivers who do not comply with orders to stop vehicles and flee; violators who do not comply with control requests, incite others to obstruct public duty officers; violators who insult, threaten, obstruct, or push public duty officers; violators who do not comply with inspections, requests to view patrol, control plans, or equipment used to detect violations; record activities of the Traffic Police officers performing duties; violators who exploit social networks to provide, share false, misleading, distorting, defamatory information, infringing on the reputation of the Traffic Police force, the honor, and dignity of individual officers while performing patrol duties, control, handling violations; drivers who steer vehicles into public duty officers; drivers using force, weapons, or dangerous items against public duty officers; in cases of flagrant offenses, individuals present in vehicles carrying prohibited items, goods, or signs of crimes; resolving cases involving foreigners, vehicles of foreigners violating traffic order, safety or other legal violations, Traffic Police command and control officers shall act according to the regulations in Article 73 of the Law on Road Traffic Order and Safety 2024, and the regulations of the Ministry of Public Security on professional patrol, control, administrative violation handling in road traffic, and other related legal provisions.
For cases where drivers record activities of Traffic Police officers performing duties, Traffic Police command and control officers shall act according to the regulations in Article 73 of the Law on Road Traffic Order and Safety 2024, and the regulations of the Ministry of Public Security on professional patrol, control, administrative violation handling in road traffic, and other related legal provisions.
It is known that Article 73 of the Law on Road Traffic Order and Safety 2024 stipulates the prevention of acts of non-compliance with inspection, control requests, obstruction, resistance against public duty officers, specifically when road traffic participants do not comply with inspection, control requests, obstruct, resist public duty officers, public duty officers shall apply the following measures:
- Explain to the violators clearly about acts of non-compliance with inspection, control requests, obstruction, resistance against public duty officers; the rights and responsibilities of violators; persuade, request an immediate cessation of violations, compliance with inspection, control requests;
- Apply preventive measures as prescribed by law in cases where violators obstruct, do not comply with inspection, control requests of public duty officers;
- In cases where violators resist public duty officers, depending on the situation, the nature, and the level of danger of the act, public duty officers may use force, support tools, or weapons as per legal regulations to prevent violations and for rightful defense.
In cases where vehicle operators participating in road traffic do not comply with signals, orders to stop vehicles and flee, public duty officers are granted the right to pursue in order to prevent and handle violations.
