Regarding this issue, LawNet would like to answer as follows:

On November 30, 2023, the Central Organizing Committee issued Instruction 26-HD/BTCTW on the implementation of organizational arrangements, cadres, civil servants, and public employees of party agencies and the Fatherland Front and socio-political organizations in localities implementing the arrangement of district and commune-level administrative units for the period 2023–30.

Instructions for arranging cadres, civil servants, and public employees when arranging administrative units for the period 2023-2030 in Vietnam

Specifically, the Central Organizing Committee has provided guidance on organizational arrangement; arrange officers, civil servants, and public employees when implementing the arrangement of administrative units at district and commune levels for the period 2023–2030 as follows:

(1) At district level

- Temporarily suspend the election and appointment of leadership, management, and recruitment and reception of officials, civil servants, and public employees at specialized advisory and assisting agencies, public service units of the Party Committee, the Vietnam Fatherland Front Committee, and socio-political organizations in district-level administrative units must arrange (hereinafter referred to as agencies and units) from the date the Provincial People's Committee submits to the Government a project to arrange district-level administrative units until the resolution of the National Assembly Standing Committee on the arrangements for each respective administrative unit takes effect, except in cases where there is a head vacancy and the person in charge cannot be arranged according to the regulations of the competent authority, the person in charge shall be elected and appointed to that position.

- The Standing Committee of the Provincial Party Committee leads, directs, and guides the affiliated Party Committees to implement:

+ Develop projects, decide on establishment, regulate functions, tasks, organizational structure, staffing, and working relationships of agencies and units in newly established district-level administrative units on the basis of merger and consolidation of the respective agencies and units in the district-level administrative units before arrangement; Arrange the heads and deputy heads of each agency and unit according to the regulations of the Central Executive Committee, Politburo, and Secretariat.

The organizational arrangement, evaluation, classification, and arrangement of cadres, civil servants, and public employees in newly established agencies and units must be carried out synchronously and in conjunction with local authorities.

Officials and civil servants who resign from leadership positions (including election and appointment) or hold a leadership position with a lower position allowance when a district-level administrative unit with sufficient qualifications, capacity, standards, and conditions has not yet been arranged and has a minimum working period of 30 months until the time of retirement are given priority when recommending for election or appointment positions held before arranging district-level administrative units or equivalent positions.

+ Build and complete the list and number of job positions; restructure the team of officials, civil servants, and public employees at new agencies and units synchronized with agencies and units of the political system at the newly established district-level unit.

+ Develop plans, roadmaps, and implement arrangements to reduce the number of leaders and managers; The number of redundant cadres, civil servants, and public employees is associated with the implementation of streamlining payrolls at new agencies and units according to the regulations of the Party and State, ensuring compatibility with local reality.

In the immediate future, the maximum number of leaders, managers, and civil servants and public employees in new agencies and units must not exceed the total number of leaders, managers, and civil servants and public employees existing before the arrangement.

The Standing Committee of the Provincial Party Committee leads, directs, and guides affiliated Party Committees at all levels to arrange and reduce the number of leaders and managers in new agencies and units; No later than 60 months from the effective date of the decision to establish the organization, general regulations will be implemented. At the same time, continue to streamline staffing according to the conclusions, regulations, and decisions of the Politburo and the Central Organizing Committee.

In special cases, the standing committee of the provincial Party Committee reports to the Central Organizing Committee and submits it to the competent authority for consideration and decision.

(2) At the commune level

- Temporarily suspend the election of commune-level officials (including: secretary, deputy secretary of the Party Committee; chairman of the Vietnam Fatherland Front Committee, head of commune-level political and social organizations) in administrative units, arrangements must be made from the date the provincial People's Committee submits to the Government a project to arrange commune-level administrative units until the resolution of the National Assembly Standing Committee, the arrangements for each respective administrative unit are effective, except in cases where there is a head vacancy and the person in charge cannot be arranged according to the regulations of the competent authority, then he or she can be elected to that position.

- The arrangement and arrangement of commune-level officials after arranging administrative units must be carried out synchronously and interconnectedly between organizations in the political system. Prioritize the placement and placement of commune-level officials with sufficient qualities, capabilities, standards, and conditions into equivalent positions, or prioritize the introduction and election of officials in commune-level administrative units when there is a need, or prioritize recruitment as civil servants (district and commune level) if qualified.

- The Standing Committee of the Provincial Party Committee leads, directs, and guides the affiliated Party Committees to develop plans, roadmaps, and implement arrangements to reduce the number of full-time officials at the commune level, ensuring that no later than 60 months from the effective date of the decision to establish the organization, it will be implemented in accordance with general regulations. In special cases, the standing committee of the provincial Party Committee reports to the Central Organizing Committee and submits it to the competent authority for consideration and decision.
