The Minister of Justice issued Circular 10/2024/TT-BTP on September 24, 2024, stipulating the codes and standards of professional titles for the Registration of Security Measures.
According to Article 5 of Circular 10/2024/TT-BTP, the Duties and professional standards for Class III public employees in charge of registration of security interests, are as follows:
(1) Tasks
- Implement recording, updating information, and backing up documents in the registration dossier, providing information files into the online registration system;
- Guide or participate in consulting for organizations and individuals requiring the registration of security measures or other related organizations and individuals;
- Participate in giving feedback on programs, plans, documents, or proposals regarding the registration of security measures or the provision of public services at the Registration Center or as assigned by competent authorities;
- Other tasks as stipulated by law or as assigned by competent authorities.
(2) Standards of Professional Competence
- Correctly implement the policies and lines of the Communist Party, the laws and policies of the State regarding the provision of public services, administrative procedures in carrying out the tasks stipulated in clause (1) of this section;
- Have the knowledge, expertise, and skills to carry out the tasks stipulated in clause (1) of this section;
- Have the competence and skills to draft documents in accordance with the tasks stipulated in clause (1) of this section;
- Have the ability to cooperate with relevant agencies, organizations, and individuals in carrying out the tasks stipulated in clause (1) of this section.
The Duties and professional standards for Class II public employees in charge of registration of security interests in Vietnam are stipulated in Article 6 of Circular 10/2024/TT-BTP as follows:
(1) Tasks
- Review registration dossiers, provide information; propose the issuance or refusal of certificates of registration of security measures, asset handling notices, or other documents; propose corrections to erroneous information, cancel registration, restore canceled registration under the functions, tasks, and powers of the Registration Center; guide and advise relevant organizations and individuals in carrying out these tasks;
- Guide professional activities for Class III public employees in charge of registration of security interests, as assigned by competent authorities;
- Provide suggestions, propose, and comment on programs, plans, documents, or proposals regarding the registration of security measures or the provision of public services at the Registration Center as assigned by competent authorities;
- Participate in resolving complaints from organizations and individuals in the field of security measure registration;
- Other tasks as stipulated by law or as assigned by competent authorities.
(2) Standards of Professional Competence
- Master and correctly implement the policies and lines of the Communist Party, the laws and policies of the State regarding the provision of public services, administrative procedures in carrying out the tasks stipulated in clause (1) of this section;
- Have the knowledge, expertise, and skills to carry out the tasks stipulated in clause (1) of this section;
- Have the ability to guide professional activities to carry out the tasks stipulated in clause (1) of this section;
- Have the competence and skills to draft documents, analyze, and explain to carry out the tasks stipulated in clause (1) of this section;
- Have the ability to cooperate with relevant agencies, organizations, and individuals in carrying out the tasks stipulated in clause (1) of this section.
The Duties and professional standards for Class I public employees in charge of registration of security interests, are as follows:
(1) Tasks
- Lead or be primarily responsible for issuing or refusing to issue certificates of registration of security measures, handling notices for secured assets, other documents, or correcting erroneous information, canceling registration, and restoring canceled registration under the functions, tasks, and powers of the Registration Center;
- Lead or be primarily responsible for providing guidance and consulting for organizations and individuals requiring the registration of security measures or other related organizations and individuals;
- Lead or be primarily responsible for developing content for guiding professional activities for Class II public employees in charge of registration of security interests and Grade III; providing professional guidance for Class II public employees in charge of registration of security interests or Grade III as assigned by competent authorities;
- Lead or be primarily responsible for developing and organizing the implementation of programs, plans, documents, or proposals regarding the registration of security measures or the provision of public services in line with the functions, tasks, and powers of the Registration Center or as assigned by competent authorities;
- Lead or be primarily responsible for resolving complaints from organizations and individuals about the registration of security measures;
- Other tasks as stipulated by law or as assigned by competent authorities.
(2) Standards of Professional Competence
- Master and correctly implement the policies and lines of the Communist Party, the laws and policies of the State regarding the provision of public services, administrative procedures in carrying out the tasks stipulated in clause (1) of this section;
- Have the knowledge, expertise, and skills to carry out the tasks stipulated in clause (1) of this section;
- Have the ability to organize, develop content, and perform tasks stipulated in points c and d of clause (1) of this section;
- Have the competence and skills to draft documents, analyze, and explain to carry out the tasks stipulated in clause (1) of this section;
- Have the ability to cooperate with relevant agencies, organizations, and individuals in carrying out the tasks stipulated in clause (1) of this section.
