Conditions for promotion from Class III to Class II public employees in charge of registration of security interests in Vietnam from November 08, 2024

According to Article 4 of Circular 11/2024/TT-BTP, the conditions for promotion from Class III to Class II public employees in charge of registration of security interests in Vietnam are as follows:

- Holding the title of Class III public employees in charge of registration of security interests - code: v.00.01.03 (hereinafter referred to as Class III public employees in charge of registration of security interests) at the time of submitting the application for promotion examination.

- Meeting the professional and career competency standards for Class II public employees in charge of registration of security interests - code: V.00.01.02 as stipulated in Clause 2, Article 6 of Circular 10/2024/TT-BTP.

- Having held the title of Class III public employees in charge of registration of security interests for at least 09 years.

In cases where the duration of holding the title of Class III public employees in charge of registration of security interests is less than 09 years, but the candidate has held an equivalent title, promotion may be considered if the total duration of holding both titles is at least 09 years, with a minimum of 01 year (12 months) holding the title of Class III public employees in charge of registration of security interests.

The duration of holding the title mentioned in this clause does not include the probationary or trial period.

- Having performed at least one of the tasks specified in Point c, Clause 1, Article 6 of Circular 10/2024/TT-BTP and having a decision or confirmation of task performance from a competent authority.

Duties and professional standards for Class II public employees in charge of registration of security interests in Vietnam

The duties and professional standards for Class II public employees in charge of registration of security interests in Vietnam are stipulated in Article 6 of Circular 10/2024/TT-BTP as follows:

(1) Duties

- Checking registration dossiers, information provision dossiers; proposing the issuance, refusal of issuance of Certificates of securing measure registration, notification of asset disposal, or other documents; proposing the correction of misinformation, cancellation of registration, or restoration of canceled registration under the function, tasks, and authority of the Registration Center; providing guidance and advice to relevant organizations and individuals in performing this duty;

- Providing professional guidance to Class III public employees in charge of registration of security interests as assigned by the competent authority;

- Advising, proposing, and commenting on programs, plans, documents, or projects related to securing measure registration or public service provision at the Registration Center as assigned by the competent authority;

- Participating in resolving complaints from organizations and individuals in the field of securing measure registration;

- Other duties as stipulated by law or as assigned by the competent authority.

(2) Professional competency standards

- Mastering and accurately implementing the policies and guidelines of the Communist Party, the State’s laws on public service provision, and administrative procedures in performing the duties outlined in clause (1);

- Possessing the knowledge, professional skills, and expertise to perform the duties outlined in clause (1);

- Capable of providing professional guidance to perform the duties specified in Point b, Clause 1, Article 6 of Circular 10/2024/TT-BTP;

- Competent in drafting documents, analyzing, and explaining to perform the duties outlined in clause (1);

- Capable of cooperating with relevant agencies, organizations, and individuals in performing the duties outlined in clause (1).
