The Department of Non-Governmental Organizations is an organization under the Ministry of Home Affairs of Vietnam, performing the function of advising and assisting the Minister of Home Affairs in state management in the field of associations, social funds, charity funds, and domestic non-governmental organizations (hereinafter collectively referred to as associations, foundations, and non-governmental organizations), conducting Red Cross activities in accordance with the law.

2. Tasks and powers of the Department of Non-Governmental Organizations in Vietnam

The Department of Non-Governmental Organizations advises and assists the Minister of Home Affairs in performing the following tasks and powers:

- Elaborate projects of laws, ordinances, and legal documents on the organization and operation of associations, funds, non-governmental organizations, and red cross activities as assigned by the Minister and submit them to competent authorities for promulgation.

- Submit to the Minister for the Minister to submit to the Prime Minister for approval the charters of national associations with Party unions assigned by the Party and State.

- Appraise and submit to the Minister for consideration and decision:

+ Permit the establishment, division, separation, merger, consolidation, dissolution, renaming, approval of the charter, and organization of term or extraordinary congresses of associations nationwide or inter-provincially. according to regulations of the Law;

+ Grant establishment license and recognizing fund charter; permit consolidation, merger, division, separation, dissolution or renaming of funds; temporary suspension of operations; allow the fund to resume operations after a definite suspension; recognition of funds eligible for operation; recognize members of the Fund Management Council; permit the change or re-issue of the establishment license; expanding the scope of activities and consolidating and converting funds; revoke the establishment license for a fund with a nationwide or inter-provincial scope of operation; funds where foreign organizations and individuals contribute assets to Vietnamese citizens and organizations for establishment and operation within the province.

- Preside over the appraisal or cooperate in appraising according to the provisions of law non-refundable aid that is not part of official development assistance of foreign agencies, organizations, and individuals (hereinafter referred to as aid) for associations, social funds, and charity funds in accordance with the law on management and use of aid for Vietnam, and submit to the Minister for consideration and approval. Annually summarize the situation of management and use of aid for associations, social funds, and charity funds, send it to the Ministry of Planning and Investment, and help the Minister check and supervise according to regulations.

- Submit to the Minister for permission for associations, social funds, and charity funds to organize international conferences and seminars according to their competence. Organize national and international conferences and seminars on the fields under the Department's functions as assigned by the Minister.

- Assume the prime responsibility for or coordinate with agencies and units in monitoring, guiding, and fostering professional skills in state management work and compliance with the law by citizens, organizations, associations, foundations, and non-governmental organizations.

- Coordinate the state management of foreign non-governmental organizations; give opinions on allowing foreign non-governmental organizations to set up representative offices, issue operating licenses, and carry out other activities in Vietnam in accordance with the law.

- Assume the prime responsibility for, and coordinate with relevant agencies and organizations in, inspecting the observance of the provisions of the law on associations, the implementation of the association's charter, and the observance of the law on Red Cross activities; inspect and supervise the organization and operation of social funds and charity funds in accordance with the law; settle and handle violations of the law; and make recommendations related to associations, funds, and non-governmental organizations.

- Consult with ministries, branches, agencies, and organizations related to the state management of associations, funds, and non-governmental organizations.

- Lead or participate in research on scientific topics in the fields under the functions of the Department as assigned by the Minister.

- Summarize and preliminarily report to the Government and the Prime Minister on a regular or irregular basis on the state management of associations, funds, and non-governmental organizations.

- Lead and coordinate with the Information Center to manage, exploit, and use the database of information on associations, funds, and non-governmental organizations; make reports and statistics on associations, social funds, charity funds, and Red Cross activities.

- Assume the prime responsibility for, and coordinate with relevant agencies in, proposing the Minister to consider and reward organizations and individuals with outstanding achievements according to their competence.
