According to Article 25 of Decree 29/2024/ND-CP, the criteria for the position title of Director General of Department and equivalent positions in Vietnam are stipulated as follows:
- The Director General of Department and equivalent is the head of the provincial level, leading, managing, and organizing the execution of state management functions and duties regarding sectors and fields in the locality of the province or centrally-run city, and executes other tasks as assigned by competent authorities; takes direct responsibility before the Provincial People's Committee, the Chairman of the Provincial People's Committee, concurrently responsible for state management in the sector and field before the Minister of the managing ministry and before the law for the assigned duties and responsibilities.
- Meet the general criteria corresponding to the provisions in Section 1, Chapter II of Decree 29/2024/ND-CP and the following provisions:
+ Deep understanding of state management, knowledge of the law concerning the managed sector and field, and the specific regulations applied locally;
+ Capacity in: Advising, directing the effective implementation of central legal documents; advising on drafting legal documents for the sector and field applied locally; directing the development of the annual and term work plan for the sector, field locally; directing or directly resolving complex, difficult issues of the sector, field locally; implementing administrative reform, public service policies on the territory; directing the implementation of inspection, auditing, processing as prescribed by law; directing the resolution of recommendations, complaints, denunciations from organizations and citizens under jurisdiction; advising leaders to coordinate with central agencies; directing unified and effective implementation of Communist Party's guidelines and policies and the law throughout the province;
+ Currently holding the position of Deputy Director General of Department and equivalent or an equivalent position or title as prescribed by the competent authority according to the personnel management decentralization.
According to Article 26 of Decree 29/2024/ND-CP, the criteria for the position title of Deputy Director General of Department and equivalent positions in Vietnam are stipulated as follows:
- The Deputy Director General of Department and equivalent is the deputy to the Director General of Department, assisting the Director General of Department in managing and organizing the execution of one or several work areas within the department's functions and duties, taking responsibility before the Director General of Department and before the law for the assigned duties and responsibilities.
- Meet the general criteria corresponding to the provisions in Section 1, Chapter II of Decree 29/2024/ND-CP and the following provisions:
+ Deep understanding of state management, knowledge of the law concerning the managed sector and field, and the specific regulations applied locally;
+ Capacity in: Advising on the effective implementation of central legal documents; advising on drafting legal documents for the sector and field applied locally; directing the development of the annual and term work plan for the sector, field locally; directing or directly resolving complex, difficult issues of the sector, field locally; directing the implementation of inspection, auditing, processing as prescribed by law; directing the resolution of recommendations, complaints, denunciations from organizations and citizens under jurisdiction; advising leaders on cooperation with central agencies; directing unified and effective implementation of Communist Party's guidelines and policies and the law throughout the province;
+ Currently holding the position of Head of the Department and equivalent belonging to the Department or an equivalent position or title as prescribed by the competent authority according to the personnel management decentralization. In the case of not holding a position, there must be continuous work experience in the sector, field for at least 07 years or more (excluding probationary period, trial period).
