Below are the procedures for conferment, promotion, demotion, and revocation of ranks in the People's Public Security of Vietnam under the Law on People's Public Security 2018.

1. Subjects, conditions, and timeframes for considering the promotion and rank conferment of officers, non-commissioned officers, and soldiers in the People's Public Security in Vietnam

The subjects, conditions, and timeframes for considering the promotion and rank conferment of officers, non-commissioned officers, and soldiers in the People's Public Security are stipulated under Article 22 of the Law on People's Public Security 2018 (amended 2023) as follows:

- Subjects for consideration for rank conferment:

+ Students receiving living expenses at the People's Public Security academies, upon graduation, will be conferred ranks as follows:

University:  Second  Lieutenant;

Junior  College:  Sergeant;

Outstanding  graduates  will  be  conferred  a  rank  one  grade  higher;

+ Officials and public employees or graduates from higher education or vocational education institutions recruited into the People's Public Security will have their rank conferred based on their training level, work process, assigned duties, and salary grade;

+ Conscription soldiers are conferred the starting rank of Private.

- Conditions for rank promotion consideration:

Officers, non-commissioned officers, and soldiers in the People's Public Security are eligible for promotion if they meet the following conditions:

+ Complete assigned duties, meet political standards, moral qualities, professional qualifications, and health requirements;

+ Current rank is lower than the maximum rank designated for the current position or title;

+ Fulfill the duration requirement for rank promotion as stipulated in Clause 3, Article 22 of the Law on People's Public Security 2018.

- Timeframes for rank promotion consideration:

+ Non-commissioned officers and service officers:

Corporal  to  Sergeant:  1  year;

Sergeant  to  Staff  Sergeant:  1  year;

Staff  Sergeant  to  Second  Lieutenant:  2  years;

Second  Lieutenant  to  First  Lieutenant:  2  years;

First  Lieutenant  to  Captain:  3  years;

Captain  to  Major:  3  years;

Major  to  Lieutenant  Colonel:  4  years;

Lieutenant  Colonel  to  Colonel:  4  years;

Colonel  to  Senior  Colonel:  4  years;

Senior  Colonel  to  Major  General:  4  years;

The  minimum  time  for  each  rank  promotion  among  generals  is  4  years;

 

+ The Minister of Public Security prescribes the timelines for salary grade elevation and technical specialty officer rank promotion corresponding to the salary range in the technical specialty pay scale stipulated by the Government of Vietnam;

+ The Minister of Public Security specifies the timelines for rank promotion consideration for non-commissioned officers and conscripted soldiers;

+ The time officers, non-commissioned officers, and soldiers spend studying at academies is counted towards the duration of rank promotion consideration; for those demoted in rank, after 1 year since being demoted, if there is improvement, they are eligible for rank promotion consideration.

- Officers considered for promotion from Colonel to Major General must have at least 3 years of service remaining; in cases where there are not 3 years of service remaining, a decision is made by the President as required.

2. Procedures for conferment, promotion, demotion, and revocation of ranks in the People's Public Security of Vietnam

According to Article 27 of the Law on People's Public Security 2018, the procedures for rank conferment, promotion, demotion, and revocation in the People's Public Security are stipulated as follows:

- The Prime Minister of the Government of Vietnam submits to the President for the conferment, promotion, demotion, and revocation of generals' ranks.

The process of conferment, promotion, demotion, and revocation of generals' ranks for seconded officers in the People's Public Security is based on the proposal of the organization or agency where they are seconded and the Minister of Public Security.

- The Minister of Public Security prescribes the procedures for the conferment, promotion, demotion, and revocation of ranks for officers, non-commissioned officers, and soldiers.
