Procedures for issuing certificates of eligibility for doing the sports business in Vietnam

Procedures for issuing certificates of eligibility for doing the sports business in Vietnam (Internet image) 

Regarding this matter, LawNet would like to answer as follows: 

The procedures for issuing certificates of eligibility for doing the sports business are regulated in Decision 775/QD-BVHTTDL in 2024 as follows:

1. Documents for certificates of eligibility for doing the sports business for professional sports clubs in Vietnam

- Documents include:

(1) Application form for Certificates of eligibility for doing the sports business (according to Form 02 in Appendix III of Decree 31/2024/ND-CP dated March 15, 2024)

(2) Copy of Business registration certificate;

(3) Summary of the preparation of business conditions (according to Form 3 in Appendix of Decree 36/2019/ND-CP dated April 29, 2019), including:

+ Sports staff meeting the requirements for professional sports activities.

+ Professional athletes, professional coaches.

+ Facilities and equipment suitable for professional sports activities.

- Number of application sets: 01 set.

- Submission methods: Submit applications by post, electronically, or in person.

2. Procedures for issuing certificates of eligibility for doing the sports business for professional sports clubs in Vietnam

- Businesses submit applications by post, electronically, or in person to the specialized sports agency under the provincial People's Committee where the sports business activities are registered or where the enterprise has its headquarters in the case of multiple sports business locations.

- The specialized sports agency under the provincial People's Committee (hereinafter referred to as the certificate issuing agency) issues an acknowledgement of receipt of the application.

- In the event that the application needs to be amended or supplemented, the certificate-issuing agency directly informs or notifies the enterprise of the content that needs to be amended or supplemented within 03 working days from the date of receiving the application.

3. Conditions for issuing certificates of eligibility for doing the sports business in Vietnam

* General conditions for sports business activities:

(1) Having a suitable team of professional staff for the activities.

(2) Having facilities and sports equipment that meet the requirements for sports activities. Specific conditions for businesses engaged in sports activities that require training instruction:

(1) Businesses engaged in sports activities that provide sports training services or engage in sports activities listed in the mandatory sports activity list specified by the Minister of Culture, Sports, and Tourism must meet the following conditions:

a) The professional staff of the sports business includes:

- Sports trainers must meet one of the following conditions:

+ Be a coach or athlete with a level of at least level 2 or equivalent that is appropriate for the registered sports business activity.

+ Have a diploma in physical education and sports from at least intermediate level or higher that is appropriate for the registered sports business activity.

+ Have undergone professional sports training as prescribed by the Minister of Culture, Sports, and Tourism.

- Rescue personnel.

- Medical staff.

b) Having facilities and sports equipment that meet the national technical standards issued by the Minister of Culture, Sports, and Tourism.

(2) Sole proprietorships and other organizations wishing to engage in sports activities that require training instruction must register their establishment as a business.

* Specific conditions for businesses engaged in extreme sports activities:

(1) Sole proprietorships and other organizations wishing to engage in extreme sports activities must register their establishment as a business.

(2) Businesses engaged in extreme sports activities listed in the extreme sports activity list specified by the Minister of Culture, Sports, and Tourism must meet the following conditions:

a) Having sufficient professional staff, including:

Sports trainers;

Rescue personnel;

On-site medical staff or a written agreement with the nearest medical facility regarding medical staff for first aid and emergency treatment for participants in extreme sports activities when necessary.

b) Having facilities and sports equipment that meet the national technical standards issued by the Minister of Culture, Sports, and Tourism.

* Specific conditions for water sports activities:

(1) Having rescue personnel.

(2) Having facilities and sports equipment that meet the national technical standards issued by the Minister of Culture, Sports, and Tourism.

(3) For sports activities on rivers, seas, lakes, or large streams, have rescue boats with engines.
