What is the level of support for participants in the security and order protection force at the grassroots level in Vietnam as of July 1, 2024?

What is the level of support for participants in the security and order protection force at the grassroots level in Vietnam as of July 1, 2024? (Internet image) 

Regarding this matter, LawNet would like to answer as follows: 

1. Entry into force of the Law on Participation in Security and Order Protection Forces at the Grassroots level in Vietnam

Based on Article 33 of the Law on Participation in Security and Order Protection Forces at the Grassroots level 2023, the entry into force of the law is as follows:

- The Law on Participation in Security and Order Protection Forces at the Grassroots level 2023 will come into effect from July 1, 2024.

- Commune Police Ordinance No 06/2008/PL-UBTVQH12 of the People's Council on Communal Police will no longer be in effect from the date the Law on Participation in Security and Order Protection Forces at the Grassroots level 2023 takes effect.

2. What is the level of support for participants in the security and order protection force at the Grassroots level as of July 1, 2024?

As mentioned, starting on July 1, 2024, when the Law on Participation in Security and Order Protection Forces at the Grassroots level 2023 comes into effect, the level of support for participants in the security and order protection force at the base is determined in Article 23 as follows:

- Participants in the security and order protection force at the Grassroots level will receive regular monthly support and voluntary social insurance and health insurance contributions according to the level determined by the Provincial People's Council.

- Participants in the security and order protection force at the grass-roots level will receive support and training when selected for training, task execution, mobilization, or deployment by competent authorities. The level of support and training is determined as follows:

+ When selected for training, participants will receive training allowances equivalent to the basic meal allowance for conscripts of the People's Police.

+ When performing tasks from 10 PM on the previous day to 6 AM the next day, on days off, holidays, or when performing arduous, hazardous and dangerous works, and extremely arduous, hazardous and dangerous works as stipulated by labor laws, participants will receive additional allowances determined by the Provincial People's Council.

+ When performing tasks in border areas, islands, mountainous areas, regions with special socio-economic disadvantages, areas with ethnic minority communities, or at key administrative units at the communal level, participants will receive additional allowances for labor days decided by the Provincial People's Council.

+ When being deployed or mobilized to perform tasks outside of their assigned area, participants will receive support for transportation and subsistence during their mission.

3. Standards and conditions for participation in the security and order protection force at the Grassroots level in Vietnam 

Based on Article 13 of the Law on Participation in Security and Order Protection Forces at the Grassroots level 2023, the standards and conditions for participation in the security and order protection force at the Grassroots level are regulated.

Vietnamese citizens who have the desire and meet the following standards and conditions are considered for selection to participate in the security and order protection force at the Grassroots level:

- Aged from 18 to 70 years old; in the case of individuals over 70 years old who are in good health, the Chairman of the Communal People's Committee will consider and decide based on the request of the Communal Police.

- Clear personal records; good moral character; individuals and their families comply with the Party's guidelines, state policies, and laws; not currently being pursued for criminal responsibilities; serving criminal sentences at the commune, ward, or town level; or subject to judicial or administrative measures. In cases where the sentence has been completed, the criminal record must be expunged; if the administrative measure has been completed, it must be considered as not being subjected to administrative measures according to the provisions of the law.

- Holding a high school diploma or having completed a lower secondary education program. For border areas, islands, mountainous areas, regions with special socio-economic difficulties, and areas with ethnic minority communities, individuals who have completed primary education can be selected.

- Currently residing or temporarily residing for at least 1 year and regularly living in the place where the citizen submits the application to participate in the security and order protection force at the base. In cases specified in paragraph 3 of Article 15 of the Law on Participation in Security and Order Protection Forces at the Grassroots level 2023, the individual must be residing or temporarily residing at the place where the application is submitted.

- Meet the health requirements according to the medical certificate issued by a legally established medical facility.
