Guidelines for regulations of the National Set of Criteria for New Rural Communes in Vietnam (Internet image)
Regarding this matter, LawNet would like to answer as follows:
On April 26, 2024, the Ministry of Culture, Sports, and Tourism issued Instruction 1807/HD-BVHTTDL to implement the criteria and indicators related to culture, sports, and tourism under the national set of criteria for new rural communes in Vietnam in the 2021–2025 period.
Specifically, the contents regarding the National Set of Criteria for New Rural Communes in Vietnam will be implemented as follows:
(1) Criterion 6.1 "Commune has a cultural house or multipurpose hall and a sports ground serving the cultural and sports activities of the whole commune":
- Location: Located in a central position to ensure convenient and easy access for all residents in the area.
- Area: Following the regulations in Clause 1 Article 6 of Circular 12/2010/TT-BVHTTDL regulating the organization, activities, and criteria of the commune-level Cultural and Sports Center; Clause 1 Article 1 of Circular 05/2014/TT-BVHTTDL amending Article 6 of Circular 12/2010/TT-BVHTTDL regulating the organization, activities, and criteria of the commune-level Cultural and Sports Center and Circular 06/2011/TT-BVHTTDL regulating the organization, activities, and criteria of the Cultural House - Sports Area in the village, Clause 2 Article 4 and Clause 2 Article 7 of Circular 01/2017/TT-BTNMT regulating the land use standards for cultural facilities, medical facilities, educational and training facilities, and sports facilities.
- Construction scale: following the regulations in Point 2.1 Clause 2 Article 6 of Circular 12/2010/TT-BVHTTDL; Clause 2 Article 1 of Circular 05/2014/TT-BVHTTDL.
(2) Criterion 6.2 "Commune has recreational and sports facilities for children and the elderly as prescribed":
- Each commune has at least 01 independent recreational and entertainment facility for the elderly and children. If it is not affordable to have separate recreational, entertainment, and sports facilities at the moment, they can be located within the premises of the Cultural and Sports Center and must have suitable operating equipment. At the same time, a commitment must be made to invest in the construction of recreational and sports facilities for the elderly and children.
- The recreational and sports facilities for children in the commune must ensure conditions and activities to prevent drowning.
(3) Criterion 6.3 "Percentage of hamlets, villages having cultural houses or cultural and sports facilities serving the community":
Depending on the nature, characteristics of each locality, area, and construction scale, the implementation will comply with the regulations in Clause 1, 2 of Article 6 of Circular 06/2010/TT-BVHTTDL regulating the organization, activities, and criteria of the Cultural House - Sports Area in the village; Article 2 of Circular 05/2014/TT-BVHTTDL; and Clause 2 Article 2 of Circular 01/2017/TT-BTNMT.
(4) The content of criterion 16 "Percentage of hamlets, villages meeting cultural standards as prescribed, having plans and implementing plans for new rural construction":
- Hamlets, villages awarded the title of "Village or street quarter of culture" must meet the standards as prescribed in Article 30 of the Law on Emulation and Commendation, Decree 86/2023/ND-CP stipulating the framework of standards and procedures, processes, and applications for consideration for awarding the title of "Family of Culture", "Village or street quarter of culture", "Typical commune, ward, or town" and documents of the provincial People's Committee stipulating detailed standards and the process of awarding the title of cultural hamlet, residential area.
- Regarding prevention of domestic violence: At the time of recognition of the New Rural Communes, the commune must not allow prominent cases of domestic violence to occur; the commune must establish a model of prevention of domestic violence in the area.
- Requirements: Building a cultural life in residential areas; hamlets and villages must be united, democratic, civilized, and achieve the title of "Village or street quarter of culture"; promoting progressive cultural practices, especially in marriage, funerals, and festivals. Enhancing the role of community self-management through the implementation of agreements and conventions; expanding and promoting new models, effective practices. Improving the quality and effectiveness of campaigns in the movement “Toàn dân đoàn kết xây dựng đời sống văn hóa” ("People's Unity in Building Cultural Life"). Ensuring accuracy, transparency, accountability, and timeliness in awarding commendation titles.
