Regarding this issue, LawNet would like to answer as follows:

On December 22, 2023, the Government Inspectorate issued Circular 02/2023/TT-TTCP guiding the functions, tasks, powers, and organization of the provincial-level Inspectorates; district-level Inspectorates; town-level Inspectorates; and city-level Inspectorates under the central government.

1. Position and functions of the District Inspectorate as of February 10, 2024 in Vietnam

According to Article 4 of Circular 02/2023/TT-TTCP, the position and functions of the District Inspectorate are as follows:

- The District Inspectorate is a specialized agency under the People's Committee at the district level, assisting the People's Committee in managing state inspections, citizen reception, complaint resolution, anti-corruption, and anti-negative practices. It carries out inspection tasks within the scope of state management of the People's Committee at the district level and performs citizen reception, complaint resolution, anti-corruption, and anti-negative tasks as prescribed by law.

- The District Inspectorate has legal entity status, a seal, and its own account; it is under the direction and administration of the Chairman of the People's Committee at the district level and receives guidance on inspection work and professional tasks from the provincial Inspectorate.

2. Tasks and powers of the District Inspectorate as of February 10, 2024 in Vietnam

The District Inspectorate performs tasks and exercises powers as prescribed by law regarding inspection work, citizen reception, complaint resolution, anti-corruption, and anti-negative practices, as well as the following specific tasks and powers:

(1) Submitting drafts of decisions and other documents on inspection work, citizen reception, complaint resolution, anti-corruption, and anti-negative practices; drafts of documents regulating the functions, tasks, powers, and organizational structure of the District Inspectorate to the People's Committee at the district level;

(2) Submitting drafts of documents on inspection work, citizen reception, complaint resolution, anti-corruption, and anti-negative practices within the jurisdiction of the Chairman of the People's Committee at the district level, if assigned;

(3) Organizing the implementation of legislative documents, programs, plans, and documents on inspection work, citizen reception, complaint handling, anti-corruption, and anti-negative practices; providing professional guidance on inspection work, citizen reception, complaint handling, anti-corruption, and anti-negative practices to agencies, organizations, units under the People's Committee at the district level, and commune-level officials and civil servants;

(4) Disseminating, promoting, and educating the law on inspection work, citizen reception, complaint resolution, anti-corruption, and anti-negative practices;

(5) Guiding, inspecting, and urging the Chairman of the People's Committee at the commune level and the head of specialized agencies under the People's Committee at the district level to implement the law on inspection work, citizen reception, complaint resolution, anti-corruption, and anti-negative practices;

(6) Regarding inspections:

- Developing draft inspection plans for the District Inspectorate, submitting them to the Chairman of the People's Committee at the district level for consideration and decision before sending them to the Provincial Inspectorate for inclusion in the provincial inspection plan;

- Organizing the implementation of tasks assigned to the District Inspectorate in the provincial inspection plan; inspecting the implementation of policies, laws, tasks, and powers of specialized agencies under the People's Committee at the district level and the People's Committee at the commune level; inspecting other cases as assigned by the Chairman of the People's Committee at the district level;

- Monitoring, urging, and checking the implementation of conclusions and recommendations of the District Inspectorate and decisions on inspections by the Chairman of the People's Committee at the district level.

(7) Regarding citizen reception, complaint resolution, and denunciation handling:

- Providing guidance to the People's Committees at the commune level and the agencies, organizations, and units under the management authority of the district-level People's Committee on citizen reception, handling of complaints and denunciations, and resolution of complaints and denunciations.

- Inspecting the implementation of the law on citizen reception, complaints, and denunciations by the specialized departments and offices under the district-level People's Committee, commune-level People's Committee, public non-business units, and other units under the management authority of the district-level People's Committee as prescribed by law; proposing measures to strengthen the work of resolving complaints and denunciations within the jurisdiction of the Chairman of the district-level People's Committee.

- Verifying, reporting on the verification results, and proposing measures to resolve complaints and denunciations within the jurisdiction of the Chairman of the district-level People's Committee when assigned.

- Monitoring, urging, and inspecting the agencies under the management authority of the Chairman of the district-level People's Committee in resolving complaints; proposing to the Chairman of the district-level People's Committee or proposing to the competent authority to apply necessary measures to end violations, consider responsibilities, and handle individuals who violate the laws on complaints.

- Reviewing the resolution of denunciations by the Chairman of the commune-level People's Committee and the heads of specialized agencies under the district-level People's Committee that have signs of violating the law; in cases where there is a basis to believe that the resolution of denunciations violates the law, proposing to the Chairman of the district-level People's Committee to review and resolve according to regulations.

- Monitoring, urging, and inspecting the implementation of decisions on complaint resolution, conclusions on denunciation content, and decisions on handling denunciations by the Chairman of the district-level People's Committee when assigned.

- Receiving, handling applications, and resolving complaints and denunciations within the jurisdiction as prescribed by law.

(8) Regarding corruption prevention and combat:

- Assisting the district-level People's Committee in managing the state's work on corruption prevention and combat; performing tasks and powers in corruption prevention and combat as prescribed by law.

- Coordinating with the State Audit Office, Investigative Agency, People's Procuracy, and People's Court in preventing, detecting, preventing, and handling corruption.

- Inspecting and supervising internal affairs to prevent corruption and negative behaviors in the activities of the district inspectorate.

(9) In the process of performing inspection duties, citizen reception, complaint resolution, denunciation handling, and corruption prevention and combat, exercising the powers of the district inspectorate as prescribed by law; requesting relevant agencies and units to assign civil servants and officials to participate in inspection teams, complaint resolution, and denunciation handling.

(10) Organizing the application of scientific and technological advances; building information systems and storage systems to serve the state management and professional tasks of the district inspectorate.

(11) Summarizing, providing information, and reporting on the results of inspection work, citizen reception, complaint resolution, denunciation handling, corruption prevention, and combat according to the regulations of the district-level People's Committee and the provincial inspectorate.

(12) Managing staffing, civil servants, and implementing regimes, policies, remuneration, commendation, and discipline for civil servants within the management scope of the district inspectorate as prescribed by law and the delegation of the district-level People's Committee.

(13) Managing and using finances and assets assigned as prescribed by law and the delegation of the district-level People's Committee.

(14) Performing other tasks assigned by the district-level People's Committee and as prescribed by law.
