Regarding this issue, LawNet would like to answer as follows:
Procedures for amending and reissuing licenses to establish representative offices of foreign advertising enterprises in Vietnam are specified in Decision 3808/QD-BVHTTDL 2023, taking effect on January 15, 2024, as follows:
* The order of execution:
- Foreign advertising enterprises request to amend and supplement the License to establish a Representative Office in the following cases shall directly submit 01 set of application documents for a Representative Office Establishment License to the People's Committee of the province/centrally-run city where the Representative Office is located:
+ Change the name;
+ Change the scope of activities;
+ Change of leader;
+ Change of headquarters location within a province or centrally run city.
- Within 10 days from the date of receipt of complete and valid documents, the Provincial People's Committee is responsible for issuing the amended and supplemented License and sending a copy of that license to the Ministry of Culture, Sports and Tourism.
* How to perform:
Send directly to the People's Committee of the province/city directly under the Central Government where the Representative Office is located.
* Components and quantity of documents:
- Document components:
(1) Application for amendment and supplementation of the License to establish a representative office of a foreign advertising enterprise signed according to the form prescribed by the Ministry of Culture, Sports, and Tourism;
(2) Certified copy of the Representative Office Establishment License.
- Number of documents: (01) set.
* The order of execution:
- Foreign advertising enterprises request to re-issue the License to establish a Representative Office in the following cases, directly submit 01 (one) set of application documents for a Representative Office Establishment License to the People's Committee of the province/centrally-run city where the Representative Office is located:
+ Change the name or registered place of establishment of a foreign advertising enterprise to another country;
+ Changes in operations of foreign advertising enterprises;
+ Lost or torn license.
- Within 10 days, from the date of receipt of complete and valid documents, the Provincial People's Committee shall consider and issue a License to establish a Representative Office and send a copy of that license to the Ministry of Culture, Sports, and Tourism. In case the dossier is not valid, within 03 days from the date of receiving it, the Provincial People's Committee will send a written request to the foreign advertising enterprise to supplement and complete the dossier.
* Submission method:
Send directly to the People's Committee of the province/city directly under the Central Government where the Representative Office is located.
* Ingredients and quantity of documents:
- Document components:
(1) Application for re-issuance of the License to establish a Representative Office signed by an authorized representative of the foreign advertising enterprise according to the form prescribed by the Ministry of Culture, Sports, and Tourism;
(2) The original License to establish a Representative Office has been issued. In case the License is lost, there must be confirmation from the police agency where the License was lost.
- Number of documents: (01) set.
- Foreign advertising enterprises are allowed to establish representative offices in Vietnam.
- Representative offices can operate with a license from the Provincial People's Committee where the foreign enterprise requests to establish a representative office.
- Representative offices are only allowed to promote advertising, not directly provide advertising services.
