In Resolution 97/NQ-CP dated June 24, 2024, on the Thematic Government Meeting on Law-making in June 2024, the Government requires completion of regulations on online advertising activities.

The Government of Vietnam has agreed on the necessity to develop a project for the Advertising Law aiming to concretize the guidelines and policies of the Party and the State regarding the construction and development of advertising activities, enhancing the efficiency and effectiveness of state management of these activities on online environments (Internet) and cross-border platforms (websites, social networks, mobile applications such as Facebook, TikTok, YouTube, etc.); promoting decentralization, delegation of authority, administrative procedure reform, and enhancing the responsibility and capacity of entities involved in advertising activities; addressing the inadequacies and difficulties in implementing the 2012 Advertising Law, to be submitted to the National Assembly for comments at the 8th session (October 2024).

The Government basically agrees with the contents of the draft Law amending and supplementing some articles of the Advertising Law; assigning the Ministry of Culture, Sports and Tourism to take the lead, in coordination with the Government Office, the Ministry of Justice, and related ministries and agencies, to study, absorb, and fully explain the opinions of the Government Members, edit, and complete the draft Law, ensuring the following requirements:

  • Completes regulations on online advertising activities, cross-border advertising services: clearly defines the conditions and specific requirements of online advertising, cross-border advertising, sanctions mechanisms to prevent and remove illegal advertisements, against tax evasion, ensuring consumer protection. International experiences on this issue should be referred to in order to build regulations suitable to Vietnam's conditions and international practices.

  • Regulations on advertising space in print newspapers and audio broadcasting; advertising time on television: Reviewing and studying regulations on advertising space in print newspapers and audio broadcasting, advertising time on television based on the principle of balancing the interests of businesses, citizens, and the State, with flexibility in the ratio of advertising space and time, making these aspects transparent for citizens and businesses to choose.

  • Regulations on the issuance of permits for advertising constructions: attaching signboards and advertising boards to existing constructions must ensure the safety of the construction itself, adjacent constructions, and the community in general. The Ministry of Culture, Sports and Tourism must study regulations on this issue to reduce administrative procedures for organizations and individuals conducting advertising while specifying sanctions to prevent and deter violations, ensuring construction safety, enhancing inspection, and supervising the quality and safety of signboards and advertising boards; in case of causing damage, they must compensate, bear other legal responsibilities as provided by law.
