Regime of making phone calls for students and inmates of reformatories in Vietnam (Internet image) 

The Minister of Public Security issued Circular 41/2022/TT-BCA dated October 27, 2022, regulating visits and meetings; receiving and sending letters, money, and gifts; Telephone contact with reformatory students and inmates of compulsory education establishments in Vietnam.

The telephone communication regime of students and inmates of reformatories is regulated as follows:

1. Regime of receiving, sending mail, and making phone calls for students and inmates of reformatories in Vietnam

Pursuant to Article 5 of Circular 41/2022/TT-BCA regulating the regime of receiving and sending mail; Phone contact as follows:

- Students receive and send letters; contact by phone according to the provisions of Clause 2, Article 24 of Decree 140/2021/ND-CP.

Campers can receive and send letters; contact by phone according to the provisions of Clause 2, Article 39 of Decree 140/2021/ND-CP.

- When contacting relatives, students, and campers by phone, you must register the contact phone number and call content.

- Principals of reformatories and directors of compulsory educational establishments are required to coordinate with local post and telecommunications agencies to install conversation booths for students and inmates to contact their relatives.

Note: The conversation booth must have staff to monitor and supervise the phone communications of students and campers.

If it is discovered that the content of the exchange is inconsistent with the registered content, contrary to educational requirements, or affects security and order, a record must be made and disciplinary action against students and camp inmates must be proposed according to regulations. .

Phone call fees are calculated according to the price of the postal and telecommunications agency and paid by students and campers (except for calls via toll-free lines).

2. Regime for receiving money and gifts from students and inmates of reformatories

Article 6 of Circular 41/2022/TT-BCA regulates the regime for receiving money and gifts as follows:

- Students receive money and gifts according to the provisions of Clause 3, Article 24 of Decree 140/2021/ND-CP.

Campers receive money and gifts according to the provisions of Clause 3, Article 39 of Decree 140/2021/ND-CP.

- Gifts from students and campers must be carefully checked by officials before being sent to reformatories or compulsory education establishments.

In cases where relatives of students or detainees buy goods at the canteen of a reformatory or compulsory educational facility, they must send them to the students or detainees; canteen sales staff must pack the goods before delivery, not taking advantage of them to hide items prohibited from being brought into reformatories or compulsory education establishments.

- In case students or campers refuse to accept money or gifts by post, a record must be made.

Reformatory schools and educational establishments are required to return postal items to the post and telecommunications agency for return to the sender, with the postage paid by the sender.

3. Regulations on management of money and objects deposited in custody in Vietnam

According to Article 7 of Circular 41/2022/TT-BCA, the management of money and objects deposited in custody is as follows:

- If students and inmates when coming to comply with the decision or while serving the decision at a reformatory or compulsory education facility, have money from the State Bank of Vietnam (Vietnamese money), checks, valuable papers, foreign currency, electronic payment cards, gold, silver, watches, rare jewelry or other valuable objects, the objects must be deposited in the custody of reformatories or compulsory educational establishments and be received back upon leaving the reformatory or compulsory educational establishment.

In case a student or camper needs to transfer the above amount of money, items, or belongings to a relative or legal representative:

Reformatory schools and compulsory educational establishments are required to transfer or deliver directly to relatives or by mail.

The transfer of money, objects, and personal belongings must be recorded; The minutes describe the status, quantity, type, shape, size, color and other characteristics. Fees for transferring money, objects, and belongings are paid by students and campers according to regulations.

- For students and detainees who have cash and objects in custody when being transferred to reformatories, other compulsory education establishments or prisons, detention camps, detention houses, officials of reformatories and compulsory education establishments are responsible for transferring this money and items to the place that receives students and camp inmates.

The delivery and receipt are recorded in writing, signed by the delivery party, the receiving party and the students and campers.

- In case a student or camper dies, it must be clearly stated in the record of the death of students or camp inmates the remaining deposit money, deposited objects, and other personal property to hand over to relatives or request the competent authority to resolve.

4. Regulations on use of deposit money in Vietnam

Article 8, Circular 41/2022/TT-BCA stipulates that students and campers can use deposit money according to the following regulations:

- Buy food, groceries, and goods at the canteens of reformatories and compulsory education establishments.

Each month, students and campers are allowed to buy food no more than 5 times the average monthly food intake, according to State regulations (this quantity is converted into money).

Money to buy goods for daily living is not included in the amount of money to buy food and extra food for students and campers.

- Pay for mail, items, and telephone contact with relatives.

- Send it back to relatives or receive it back after completing the decision.

Circular 41/2022/TT-BCA takes effect on December 12, 2022.
