Ms. Phan Hong Hang (Email: phanhonghang***@gmail.com) raised the following inquiry: “Many agencies stipulate that the validity period of a certified copy is 03 months, 06 months… So, what is the validity period of a certified copy? Which document regulates this?”
Regarding this matter, THU KY LUAT would like to respond to Ms. Phan Hong Hang as follows:
1. Clauses 1 and 2, Article 3 of Decree 23/2015/ND-CP on issuing copies from the original books, certifying copies from originals, certifying signatures, and certifying contracts and transactions (effective from April 10, 2015) stipulate:
(i) Copies issued from original books are valid for use as substitutes for the originals in transactions, except where otherwise stipulated by law.
(ii) Copies certified from originals as regulated in this Decree are valid for use as substitutes for the originals that were used for certification in transactions, except where otherwise stipulated by law.
2. As of the present time, there are no legal regulations that limit the validity period of certified copies.
Thus, it can be understood that the validity of certified copies is indefinite.
