What is the fine for making untimely correction and apology according to law in Vietnam?

Recently, the Government of Vietnam issued Decree 119/2020/ND-CP on penalties for administrative violations in journalistic and publishing activities.

What is the fine for making untimely correction and apology according to law in Vietnam? (Illustration)

According to Article 10 Decree 119/2020/ND-CP, a warning for correction or apology in breach of regulations on position, typeface or font size.

- A monetary fine from 1,000,000 VND to 3,000,000 VND applies for any of the following acts:

= Failing to notify the correction, apology to the relevant agency, organization, or individual;

= Publishing, broadcasting correction, apology information without reflecting the content of the correction, apology or the name of the journalistic work, column name, issue number, date, month, year that needs correction.

- A fine from VND 3,000,000 to VND 5,000,000 for the action below:

= Failure to remove false information;

= Failure to notify the media organizations or news websites with agreement on using their articles to post the correction and apology;

= The magazine that publishes an issue per over 30 days publishes false information but fails to provide an instant answer for the concerned entity;

= Failure to set up a separate column on the home page of the electronic newspaper or online magazine for the correction and apology;

= Posting the correction and apology without quoting the adequate false information that distorts, slanders, and offends the prestige of the corporate or the honor and dignity of the individual in the press product and the corrected information;

= Making untimely correction and apology according to law.

- A monetary fine from 10,000,000 VND to 20,000,000 VND applies for any of the following acts:

= Failure to correct or apologize according to regulations;

= Failure to post the conclusion of competent regulatory agency about the false information that distorts, slanders, and offends the prestige of the corporate or the honor and dignity of the individual in the press.

In addition to monetary fines, specific remedial measures may include:- Forced corrections, apologies for actions failing to comply with regulations;

- Forced re-publication, re-broadcast of corrections, apologies for actions of publishing, broadcasting correction, apology information without fully presenting the contents of false information, distortion, defamation, or insult to the dignity or reputation of an individual or organization;

- Forced publication of complete conclusions of competent state agencies for actions failing to publish, broadcast conclusions on false, distorted, or defamatory information;

- Forced removal of false information for actions failing to remove such information.
