Vietnam: Persons evading medical isolation can be fined up to 20,000,000 VND

This is the main content stipulated in Decree 117/2020/ND-CP issued on September 28, 2020 by the Government of Vietnam on penalties for administrative violations in medical sector in Vietnam.

According to Decree 117/2020/ND-CP, violations against regulations on medical isolation and coercive medical isolation in Vietnam shall result in the following penalties:

1. A fine ranging from VND 5.000.000 to VND 10.000.000 shall be imposed for the commission of one of the following violations in Vietnam:

- Failing to organize or force medical isolation in case of compulsory medical isolation prescribed by law, except for failing to organize medical isolation of persons infected with group A infectious diseases;

- Refusing or evading medical isolation or coercive medical isolation measures implemented by competent authorities, except for refusing or evading the implementation of a competent authority’s decision on medical isolation or coercive medical isolation of persons infected with group A infectious diseases, border health quarantine subjects infected with group A infectious diseases or at the request of a competent authority;

- Failing to compile the list and monitor the health of persons in close contact with persons who are managed under isolation or coercive isolation as prescribed by law.

2. A fine ranging from VND 15.000.000 to VND 20.000.000 shall be imposed for commission of one of the following violations in Vietnam:

- Failing to organize medical isolation of persons infected with group A infectious diseases;

- Refusing or evading the implementation of a competent authority’s decision on medical isolation or coercive medical isolation of persons infected with group A infectious diseases, border health quarantine subjects infected with group A infectious diseases or at the request of a competent authority;

- Organizing medical isolation or coercive medical isolation at an unqualified location.

3. Remedial measure:

Enforced organization of medical isolation or coercive medical isolation for failing to comply with the legal regulations in Vietnam
