Vietnam: Guidance on determining agencies affiliated to public service providers (Illustrative Image)

According to Decree 120/2020/ND-CP:

1. Public service providers (except public service providers under the Ministry of Public Security and the Ministry of National Defense) within the management scope of ministries and ministerial agencies (hereinafter collectively referred to as ministries), including:

+ Public service providers under the ministry (including Public service providers under the organizational structure of the ministry, public service providers affiliated to the ministry, and overseas public service providers);

+ Public service providers under general departments and equivalent organizations under the ministry (hereinafter collectively referred to as general departments under the ministry);

+ Public service providers under departments and sub-departments under the ministry;

+ Public service providers under the Office of the Ministry;

+  Public service providers under departments within general departments under the ministry.

2. Public service providers under agencies under the Government of Vietnam (including overseas public service providers).

3. Public service providers under organizations established by the Government of Vietnam or the Prime Minister of Vietnam that are not public service providers.

4. Public service providers within the management scope by the Provincial People’s Committees, including:

+ Public service providers under the Provincial People’s Committees;

+ Public service providers under specialized agencies under the Provincial People’s Committees (hereinafter collectively referred to as departments);

+ Public service providers under sub-departments and equivalents under departments;

+ Public service providers under other administrative organizations under the Provincial People’s Committees.

5. Public service providers under the People’s Committees of districts, towns, district-level towns, provincial cities, and centrally governed cities (hereinafter collectively referred to as district level).

Additionally,

- The establishment, reorganization, and dissolution of public service providers within the management scope of the special administrative–economic zones are carried out in accordance with the law and guiding documents.

- The establishment, reorganization, and dissolution of agencies under the Government of Vietnam shall follow the Law on the Organization of the Government of Vietnam and other related legislative documents.
