This is the content mentioned in the Draft Law on amendments to the Trade Union of Vietnam in 2021. This Draft Law stipulates acts that are prohibited in trade unions.
Specifically, according to Article 1 of the Law on amendments to the Trade Union in 2021 of Vietnam amending Article 9 of the Law on Trade Union 2012, prohibited acts are as follows:
- Hindrance, causing difficulties in implementation of Trade Unions’ rights;
- Differentiation and treatment of workers and trade union officials based on the establishment, membership, or activities in the trade union, including:
+ Requiring or not requiring participation in the trade union or leaving the trade union as a condition for recruitment, conclusion, or extension of labor contracts;
+ Dismissal, disciplinary actions, unilateral termination of labor contracts, termination of employment contracts, refusal to renew or extend labor contracts, employment contract changes for workers;
+ Differential treatment in terms of wages, working hours, and other rights and obligations in the employment relationship;
+ Obstructing or causing difficulties related to work to weaken the activities of the trade union;
- Utilizing economic measures or other measures to interfere, manipulate the process of establishing and operating trade unions in order to render them ineffective or weaken the performance of trade union functions;
- Exploiting trade union rights to violate laws, encroach upon the interests of the State, and legitimate rights and interests of agencies, organizations, enterprises, and individuals.
Therefore, this draft strictly prohibits discriminatory treatment among trade union members in terms of rights and obligations, encroachment upon the common interests of trade unions, and actions that weaken trade unions.
