Vietnam: Amendments to regulations on trade union funds from 2021

Specifically, according to Article 1 of the Law on amendments to the Trade Union in 2021 of Vietnam amending Clause 2 Article 26 of the Law on Trade Union 2012 on trade union funds:

- Option 1: Trade union funds are paid by agencies, organizations and enterprises in 2% salary funds based to pay social insurance for laborers. For enterprises with two or more representative organizations of workers at the grassroots level, this fund shall be distributed to the representative organizations of workers at the grassroots level in accordance with the regulations set by the Government.

- Option 2: Trade union funds are paid by agencies, organizations and enterprises in 2% salary funds based to pay social insurance for laborers. 70% of this fund is allocated to the grassroots trade unions to fulfill their tasks as prescribed by the law and the Constitution of the Vietnam Trade Union.

Therefore, this draft regulation stipulates that the trade union funds are paid by agencies, organizations and enterprises in 2% salary funds based to pay social insurance for laborers.
