From November 15, fine of up to VND 10 million for renting out pharmacy practicing certificate Vietnam

This is a noteworthy content in Decree 117/2020/ND-CP stipulating penalties for administrative violations in medical sector in Vietnam issued by the Government of Vietnam on September 28, 2020.

From November 15, fine of up to VND 10 million for renting out pharmacy practicing certificate Vietnam (illustrated image)

Decree 117/2020/ND-CP stipulates that a fine ranging from VND 5.000.000 to VND 10.000.000 shall be imposed for commission of one of the following violations in Vietnam:

- Forging one of required documents in the application for the pharmacy practicing certificate;

- Practicing pharmacy without obtaining the pharmacy practicing certificate or while the pharmacy practicing certificate at the job position requiring the pharmacy practicing certificate has been suspended;

- Acting as the chief pharmacist of two or more pharmacy business establishments or at two or more pharmacy business locations;

- Practicing pharmacy beyond the scope written on the pharmacy practicing certificate and technical and professional regulations;

- The institution providing training and refresher programs in pharmacy fails to meet eligibility requirements set by law;

- The organization that administers the examination for the pharmacy practicing certificate fails to meet eligibility requirements set by law;

- Renting, lending or allowing others to use the pharmacy practicing certificate.

At the same time, a fine ranging from VND 10.000.000 to VND 20.000.000 shall be imposed for using a rented or borrowed pharmacy practicing certificate.

Additionally, the person renting out the pharmaceutical practice certificate will be required to forfeit any illegal profit obtained from the act of renting or borrowing the pharmaceutical practice certificate to practice pharmaceuticals.

More details can be found in Decree 117/2020/ND-CP which comes into effect in Vietnam from November 15, 2020.
