This is a significant and important content of Decree 119/2020/ND-CP of the Government of Vietnam on penalties for administrative violations in journalistic and publishing activities, issued on October 07, 2020.
From December 01, 2020, what is the fine for act of export and import of printed magazine with contents of debauchery act in Vietnam? (Illustration)
Article 15 Decree 119/2020/ND-CP stipulates the penalties for violations of regulations on the import and export of printed newspapers and magazines in Vietnam as follows:
- A fine of 3,000,000 VND to 5,000,000 VND for importing printed newspapers and magazines without registering the list of imported newspapers with the Ministry of Information and Communications before importation.
- A fine of 5,000,000 VND to 10,000,000 VND for importing printed newspapers and magazines without going through an import facility for newspapers licensed by the Ministry of Information and Communications.
- A fine of 10,000,000 VND to 20,000,000 VND for one of the following acts:
= Importing or exporting the print newspaper or magazine with contents promoting bad tradition, superstitions; mystical stories that cause confusion in the society, which adversely affects the social order and safety and health of the community;
= Importing or exporting the print newspaper or magazine with contents that do not suit Vietnamese fine customs;
= Importing or exporting the print newspaper or magazine with contents that affect the normal physical and mental development of children;
= Importing or exporting the print newspaper or magazine with contents that infringes on individual secret or correspondence secrecy.
- A fine of 30,000,000 VND to 50,000,000 VND for one of the following acts:
= Importing or exporting the print newspaper or magazine with contents about obscenity or debauchery act;
= Importing or exporting the print newspaper or magazine with false contents that distort or offend the honor, prestige of the corporate or the honor and dignity of the individual.
- A fine of 70,000,000 VND to 100,000,000 VND for importing or exporting printed newspapers and magazines containing content that incites violence.
- A fine of 150,000,000 VND to 200,000,000 VND for importing printed newspapers and magazines containing content that affects national interests but not to a criminal prosecution level.
- A fine of 150,000,000 VND to 200,000,000 VND for exporting printed newspapers and magazines containing content that affects national interests but not to a criminal prosecution level.
Additionally, the license for importing printed newspapers and magazines may be revoked for 3 to 12 months for acts that affect national interests without reaching a criminal prosecution level.
Apart from being fined, certain violations are also subject to compulsory destruction of the infringing publications, confiscation of unlawful profits obtained through administrative violations, or compulsory re-export of printed newspapers and magazines in Vietnam.
