On October 07, 2020, the Government of Vietnam promulgated Decree 119/2020/ND-CP stipulating administrative penalties for violations in journalism activities and publishing activities.
From December 01, 2020, fine of up to 10 million VND for act of selling illegally-imported press product in Vietnam (Illustrative image)
Article 13 of Decree 119/2020/ND-CP stipulates a fine ranging from 5,000,000 dong to 10,000,000 dong for any of the following acts in Vietnam:
- Obstructing the distribution, transmission of legally press-related products, press information products;
- Selling illegally imported press products.
Besides, a fine ranging from 20,000,000 dong to 40,000,000 dong will be imposed for any of the following acts:
- Distributing press products, press information products that are not allowed to circulate or are subject to recall and confiscation;
- Failing to recall press publications, press information products when there is a recall decision.
Specifically, the above violations may also be subject to the confiscation and destruction of press information products or be required to return the illegal profits obtained from the administrative violations.
Moreover, Article 12 of Decree 119/2020/ND-CP stipulates a warning for acts of failing to provide or inaccurately providing content as required for press information, newsletters, special issues. A fine ranging from 500,000 dong to 1,000,000 dong is imposed for presenting on the front page, cover page for printed newspapers and magazines, homepage, and sections for electronic newspapers and magazines with content inconsistent with the press product's content. A fine ranging from 3,000,000 dong to 5,000,000 dong is imposed for failing to display the symbol, and jingle for radio and television newspapers.
