Regarding this matter, LawNet would like to answer as follows:
On April 12, 2024, the Minister of Justice of Vietnam issued Decision 639/QD-BTP on the Drafting Plan for the Law on Issuance of Legislative Documents (Amended).
The drafting plan for the Law on Issuance of Legislative Documents (Amended) includes the following:
(1) Forming the drafting plan for the Law on Issuance of Legislative Documents (Amended) to submit to the leadership of the Ministry for approval; allocating human resources, budget, and other resources for plan implementation.
(2) Establishing the drafting committee and editorial team; conducting surveys at various ministries, sectors, and localities; studying foreign experiences to develop a detailed outline of the draft Law on Issuance of Legislative Documents (Amended); organizing workshops and discussions to gather opinions on the detailed outline.
(3) Compiling the project documentation for the Law on Issuance of Legislative Documents (Amended), including the draft proposal, the draft law, a report on reviewing relevant Legislative Documents related to the law project, an assessment of administrative procedures in the draft law, a report on integrating gender equality issues in the draft law, a report on foreign experiences related to the draft law, a synthesis document, an explanation, and the incorporation of feedback; and other relevant documents if applicable.
(4) Organizing meetings of the drafting committee and editorial team to review and approve the detailed outline of the draft Law on Issuance of Legislative Documents (Amended); discussing the content of the draft law, the draft proposal, and other related documents; providing opinions on organizing public consultations on the law project, the process of incorporating and explaining feedback to improve the draft before submitting it for review, and the process of explaining and incorporating review opinions to finalize the draft for submission to the Government.
(5) Publishing on the electronic portal of the Government, the Ministry of Justice; organizing consultations with agencies, organizations, and individuals regarding the draft Law on Issuance of Legislative Documents (Amended): soliciting written opinions and conducting consultations through workshops, discussions, and media coverage of the law project.
(6) Reviewing and explaining, incorporating the review opinions regarding the draft Law on Issuance of Legislative Documents (Amended).
(7) Submitting the draft Law on Issuance of Legislative Documents (Amended) to the Government; refining and amending the project documentation according to the Government's opinions.
(8) Submitting the draft Law on Issuance of Legislative Documents (Amended) to the Standing Committee of the National Assembly for examination, comments, and incorporating the explanations and review opinions of the Standing Committee of the National Assembly.
(9) Submitting the draft Law to the National Assembly for consideration and comments (first round).
(10) Revising the draft Law between two sessions based on the opinions of the National Assembly members; reporting to the Standing Committee of the National Assembly on the revision of the law project for submission to the National Assembly.
(11) Submitting the draft Law to the National Assembly for consideration and approval.
(12) Promulgating the Law.
The implementation of the drafting plan for the Law on Issuance of Legislative Documents (Amended) must ensure the following requirements and objectives:
- Implementing the construction of the draft Law on Issuance of Legislative Documents (Amended) based on the policies already approved by the Government.
- Developing the project documentation for the Law on Issuance of Legislative Documents (Amended) in accordance with the regulations, ensuring quality and adhering to the set timeline.
- Clearly assigning tasks and responsibilities to each unit, collective, and individual during the implementation process.
