Officials and public employees who meet all conditions regarding duration at the grade and standards for regular salary increment will have their salaries periodically increased as regulated. Therefore, what are cases of delay in salary increase for officials and public employees in Vietnam?

According to the provisions of Article 2 of Circular 08/2013/TT-BNV, officials and public employees in Vietnam are eligible for periodic salary increases (promotion by 01 salary grade) if they meet the following conditions:
- Sufficient time holding the grade to consider a periodic salary increase:
- For the title of senior specialist: If not yet placed at the highest salary grade in the senior specialist salary table, then after 5 years (60 full months) holding the salary grade in the senior specialist salary table, a salary grade increase will be considered;
- For ranks and titles requiring educational qualifications from college or higher: If not yet placed at the highest salary grade in the rank or title, then after 3 years (36 full months) holding the salary grade in the rank or title, a salary grade increase will be considered;
- For ranks and titles requiring educational qualifications from intermediate level or lower and subordinate, service staff: If not yet placed at the highest salary grade in the rank or title, then after 2 years (24 full months) holding the salary grade in the rank or title, a salary grade increase will be considered.
- Meeting the standards for periodic salary grade increase:
- For officials: Evaluated by the competent authority from the level of task completion but with limited capacity or higher and not subject to disciplinary actions such as reprimand, warning, demotion, dismissal.
- For public employees: Evaluated by the competent authority from the level of task completion or higher and not subject to disciplinary actions such as reprimand, warning, dismissal.
Thus, under these regulations, to get periodic salary grade increases, officials and public employees must fully meet the above conditions. However, during the time holding the current salary grade, if officials and public employees have received a notice or a written decision from the competent authority determining that they have not completed their assigned tasks annually or have been disciplined with one of the forms such as reprimand, warning, demotion, dismissal, the period for calculating the periodic salary grade increase will be extended compared to the regulated time as follows:
First: Extension of 12 months (one year) for the following cases:
- Executive Officials disciplined by dismissal;
- Officials disciplined by demotion or dismissal;
- Public employees disciplined by dismissal.
Second: Extension of 06 (six) months for the following cases:
- Officials disciplined by reprimand or warning;
- Public employees disciplined by warning;
- Officials, employees who have not completed their annual tasks. (Note: if during the time holding the grade, there are 02 non-consecutive years of not completing the assigned tasks, each year of not completing the tasks will extend by 06 (six) months).
Third: Extension of 03 (three) months for public employees and workers disciplined by reprimand.
Fourth: In cases of both not completing the assigned tasks and being disciplined, the period of extension for the periodic salary grade increase is the total of the extended periods mentioned above.
Especially note, for officials and public employees who are party members disciplined by the Communist Party, follow the provisions in Regulation 1102-QD/TW of 2017. The extension of the periodic salary grade increase is based on the form of disciplinary action decided by the managing authority of officials, public employees, and workers according to legal regulations.
