Regarding this issue, LawNet would like to answer as follows:
According to Clause 1, Article 2 of Decree 93/2021/ND-CP, organizations and individuals mobilize, receive, and distribute voluntary contributions:
(1) Vietnam Fatherland Front Committee calls and campaigns; Board of Campaigning, receiving and distributing voluntary contributions (an organization established by the Standing Committee of the Vietnam Fatherland Front Committee at the same level - hereinafter referred to as the Board of Campaigning), receives and distributes voluntary contributions to overcome difficulties caused by natural disasters, epidemics, and incidents;
(2) Vietnam Red Cross mobilizes, receives, and distributes voluntary contributions to overcome difficulties caused by natural disasters, epidemics, and incidents;
(3) Ministries, ministerial-level agencies, Government agencies, Provincial People's Committees, District-level People's Committees mobilize, receive, and distribute voluntary contributions to overcome difficulties caused by natural disasters, epidemics, and incidents.
Commune-level People's Committees receive and distribute voluntary contributions when authorized by district-level People's Committees according to the provisions of the law;
(4) The National Steering Committee for Natural Disaster Prevention and Control mobilizes and receives voluntary contributions from the international community in emergency situations involving natural disasters;
(5) Mass media agencies and medical facilities mobilize, receive, and support patients with serious diseases;
(6) Charitable funds specified in Decree 93/2019/ND-CP on the organization and operation of social funds and charity funds (hereinafter referred to as charity funds) mobilization, receipt, and distribution sources of voluntary contributions to overcome difficulties caused by natural disasters, epidemics, and incidents and support patients with serious diseases;
(7) Enterprises, cooperatives, and other organizations with legal status participate in mobilizing, receiving, and distributing voluntary contributions to overcome difficulties caused by natural disasters, epidemics, and incidents; support patients with serious illnesses;
(8) Individuals with full capacity for civil acts participate in mobilizing, receiving, and distributing voluntary contributions to overcome difficulties caused by natural disasters, epidemics, and incidents; Support patients with serious illnesses.
When natural disasters, epidemics, or incidents occur that cause damage to people, property, or affect people's lives, depending on the level and scope of the damage, calling and mobilizing voluntary contributions from organizations is carried out in the following ways:
- The Presidium of the Central Committee of the Vietnam Fatherland Front or the Chairman of the Provincial Committee of the Vietnam Fatherland Front calls for and mobilizes organizations and individuals to make voluntary contributions to support people and damaged localities.
- Vietnam Red Cross Society calls for and mobilizes domestic and foreign Red Cross organizations to provide support according to current legal regulations on Red Cross activities.
- Mass media agencies responded to the call of the Presidium of the Central Committee of the Vietnam Fatherland Front, the Provincial Vietnam Fatherland Front Committee mobilizes organizations and individuals to make voluntary contributions to help overcome difficulties caused by natural disasters, epidemics, and incidents according to the provisions of the law.
- Charitable funds call for and mobilize organizations and individuals to make voluntary contributions to overcome difficulties caused by natural disasters, epidemics, and incidents occurring in the areas within their scope of operation.
- Enterprises, cooperatives, and other organizations with legal status call on and mobilize organizations and individuals to make voluntary contributions to overcome difficulties caused by natural disasters, epidemics, and incidents. When mobilizing voluntary contributions, organizations must make announcements on their websites or media that commit to the purpose, scope, methods, forms of mobilization, subjects of support, and time of support implementation and send them in writing to the Commune People's Committee where the head office is located according to the Notification form issued with Decree 93/2021/ND-CP.
Commune-level People's Committees are responsible for storing, monitoring, and providing information upon request from organizations and individuals contributing or receiving support and competent agencies serving the work of guiding, monitoring, inspecting, examining, supervising, and handling violations.
- The National Steering Committee for Natural Disaster Prevention and Control calls for and mobilizes voluntary contributions from the international community in emergency situations involving natural disasters.
Ministries, ministerial-level agencies, Government agencies, Provincial People's Committees, District-level People's Committees call on and mobilize organizations and individuals to make voluntary contributions to overcome difficulties caused by natural disasters, epidemics, and incidents.
