1. Position and function of the Inspectorate of the Ministry in Vietnam

The position and function of the Inspectorate of the Ministry according to Article 14 of the Inspection Law 2022 are as follows:

- The Inspectorate of the Ministry is an agency of the Ministry, assisting the Minister in state management regarding inspection work, citizen reception, complaint, denunciation resolution, and anti-corruption, anti-negative activities; conducting administrative inspections of agencies, organizations, and individuals under the Ministry's management; conducting specialized inspections in areas under the state management of the Ministry as stipulated by the Minister, ensuring no overlap with the functions and tasks of the Departmental and Directorate Inspectorates and other agencies within the Ministry tasked with specialized inspections; carrying out tasks of citizen reception, complaint, and denunciation resolution, and anti-corruption, anti-negative activities as prescribed by law.

- The Inspectorate of the Ministry is under the leadership and direction of the Minister and under the direction and professional guidance of the Government Inspectorate of Vietnam.

2. Tasks and powers of the Inspectorate of the Ministry in Vietnam

The tasks and powers of the Inspectorate of the Ministry according to Article 15 of the Inspection Law 2022 are as follows:

- In the field of inspection, the Inspectorate of the Ministry assists the Minister in state management of inspection work and has the following tasks and powers:

+ Advise, draft, present to the Minister for issuance, guide, and expedite the implementation of regulations on the organization and operation of inspections under the Ministry's state management authority;

+ Draft the Ministry's inspection plan, guide the drafting of inspection plans by the Directorate, Departments, and other agencies under the Ministry tasked with specialized inspections to integrate into the Ministry's inspection plan and present to the Minister for issuance;

+ Organize the implementation of the Inspectorate of the Ministry's inspection plan; monitor, expedite, and oversee the execution of inspection plans by the Directorate, Departments, and other agencies within the Ministry tasked with specialized inspection functions;

+ Conduct administrative inspections of agencies, organizations, and individuals under the jurisdiction of the Minister; conduct specialized inspections in fields under the Ministry's state management scope, except for areas delegated to the Directorate, Departments, and other agencies within the Ministry tasked with specialized inspections;

+ Inspect on content related to multiple fields under the Ministry's state management scope;

+ Inspect other cases as assigned by the Minister;

+ Re-inspect cases that have already been concluded by the Directorate, Departments, and other agencies within the Ministry tasked with specialized inspections; cases within the Ministry’s state management scope concluded by the provincial inspectorate but found to have signs of legal violations through grievance, denunciation, petition, or reflection review;

+ Monitor, expedite, and examine the implementation of conclusions, recommendations of the Inspectorate of the Ministry, and the Minister's inspection decisions;

+ Examine the accuracy and legality of the inspection conclusions by the Directorate, Departments, and other agencies within the Ministry tasked with specialized inspections, and post-inspection processing decisions by the Chairperson of the Provincial People's Committee for cases under the Ministry's management scope as necessary;

+ Guide inspection operations for the Directorate, Departments, other agencies within the Ministry tasked with specialized inspections, and provincial inspectorates;

+ Summarize and report on inspection results.

- Assist the Minister in executing state management of citizen reception, complaint, and denunciation resolution; fulfill tasks and powers in citizen reception, complaint, and denunciation handling as prescribed by law.

- Assist the Minister in executing state management of anti-corruption and anti-negative work; fulfill tasks and powers in anti-corruption and anti-negative activities as prescribed by law.

3. Organizational structure of the Inspectorate of the Ministry under the Law on Inspection 2022 in Vietnam

The organizational structure of the Inspectorate of the Ministry according to Article 17 of the Inspection Law 2022 is as follows:

- The Inspectorate of the Ministry includes the Chief Inspector, Deputy Chief Inspector, Inspectors, and other officials.

The Chief Inspector of the Ministry is appointed, dismissed, rotated, transferred, or seconded by the Minister after consulting the Chief Government Inspector of Vietnam.

- The Inspectorate of the Ministry's organization is implemented in accordance with legal regulations on the organization of the Government of Vietnam and other relevant legal provisions.
