Regulations on documents, materials, and information to prove legal residence for registration of residency in Vietnam from January 10, 2025
According to Article 5 of Decree 154/2024/ND-CP, guidelines are stipulated regarding documents, materials, and information proving legal residence to register for residency starting January 10, 2025, as follows:
Citizens are to provide information proving their legal residence to the residency registration authority when submitting residency registration applications. The residency registration authority is responsible for accessing this information through the electronic ID card, electronic identification account on the identification and electronic verification system via the National Identification Application or in the National Database on Population, Residency Database, electronic data management repositories for organizations and individuals on the National Public Service Portal, the Information System for Administrative Procedure Resolution at department, provincial level or other national databases, specialized databases.
In cases where information proving legal residence cannot be accessed in the database, information system, or national identification application, the residency registration authority is responsible for verifying and resolving the residency procedures; the citizen is responsible for providing a photocopy, photograph, or electronic version of one of the documents or materials proving legal residence upon the request of the residency registration authority.
* Permanent Residence Registration
Documents and materials proving legal residence for permanent residence registration include one of the following:
- Documents, materials certifying land use rights, property rights attached to the land granted by competent authorities over various periods according to the legal regulations on land and housing;
- Housing construction permits or temporary housing construction permits where construction permits are required under legal regulations on construction;
- Documents of sale of state-owned housing or documents on pricing, liquidation of housing attached to homestead land owned by the state as per legal regulations;
- House purchase contracts or documents proving the handover or receipt of houses from real estate business enterprises constructed for sale;
- Documents on purchasing, leasing-purchasing, receiving as gifts, inheriting, contributing capital, exchanging houses in accordance with legal regulations on land and housing;
- Documents on the allocation of gratitude houses, charity houses, solidarity houses, housing, or homestead land for individuals, families;
- Documents from the Court or a competent state authority resolving ownership of a house that has legal effect;
- Documents, materials proving the mortgage, pledge of ownership rights to a legal residence;
- Confirmation from the People's Committee at the commune level regarding stable, undisputed use of housing or homestead land and not located at sites not eligible for new permanent residence registration as per Sample No. 02 issued with Decree 154/2024/ND-CP;
- Documents, materials proving the registration, inspection of owned vehicles, confirmation of the registration of regular parking of vehicles except for cases where registration of regular parking is not required as per clause 2 Article 3 Decree 154/2024/ND-CP;
- Contracts, documents for leasing, lending, or allowing residence that are notarized or authenticated per legal regulations;
- One of the other types of documents, materials to consider issuing certificates of land use rights, ownership rights of other property attached to the land as per legal regulations on land and housing over different periods.
* Temporary Residence Registration
Documents and materials proving legal residence for temporary residence registration include one of the following:
- One of the documents, materials stipulated for permanent residence registration mentioned above, except where documents, materials proving legal residence consist of a lease, lending, or permission for temporary residence from agencies, organizations, individuals where such documents do not require notarization or authentication (**);
- A citizen’s declaration of commitment regarding their right of usage of unsettled housing and stable, long-standing residence at the location if there aren't any documents, materials as noted in (**). The content of the commitment includes: Full name; date, month, year of birth; personal identification number; place of residence; information about the address requested for temporary residence registration and the citizen’s commitment;
- Documents, materials from the owner of tourist accommodation facilities, or other accommodation facilities allowing individuals to register for temporary residence at that facility;
- Documents from the agencies, organizations managing industrial zones, export processing zones, economic zones permitting workers to register for temporary residence at accommodations within their ownership or management as per legal regulations;
- Documents from agencies, organizations managing constructions, building sites, dormitories, craft villages, production and business facilities, organizations permitting workers to register for temporary residence at accommodations within their ownership or management as per legal regulations.
* Permanent Residence Registration at Legal Residences that are Rented, Loaned, or Stayed With
Documents and materials proving compliance with minimum housing area requirements to register for permanent residence at legal residences by rental, loan, or staying with, as stipulated in clause 3 Article 20 of the Law on Residency, include one of the following:
- Documents and materials stipulated for permanent residence registration as mentioned above, which specify the residential area;
- Confirmation from the People's Committee at the commune level regarding average residential area conditions compliant with regulations from the People's Council of the province, centrally-run city, according to Sample No. 02 issued with Decree 154/2024/ND-CP.
