Regarding this issue, LawNet would like to answer as follows:
- The Department of Performing Arts is an administrative organization under the Ministry of Culture, Sports, and Tourism, performing the function of advising, assisting the Minister in state management and organize law enforcement on performing arts and literary activities nationwide; Manage public services in the field of performing arts and literature according to the provisions of the law.
- The Department of Performing Arts has its own seal and an account at the State Treasury.

The duties and powers of the Department of Performing Arts are specified in Article 2 of Decision 789/QD-BVHTTDL 2023, including:
- Submit to the Minister draft legal documents and decentralize state management of performing arts activities.
- Submit to the Minister long-term and annual strategies, projects, and plans for performing arts and literature.
- Organize, guide, and inspect the implementation of legal documents, strategies, projects, and legal regulations on performing arts activities under state management authority after approval; propaganda, dissemination, legal education, and information on state management activities of performing arts.
- Submit to the Minister a plan to sponsor and order the creation and staging of programs, performances, plays, audio and video recording products, and other public services using the state budget for artistic activities | performance.
- Appraise and submit to the Minister for approval valid and complete documents according to regulations on:
+ Organize art performances within the framework of international cooperation of specialized performing arts associations under the Central Government, public service units with art performance functions under the Central Government;
+ Organize national and international competitions and festivals of specialized performing arts associations under the Central Government and public service units with performing arts functions under the Central Government.
- Approve or stop organizing art performances, competitions, and festivals of all types of performing arts; cancel the results of competitions and festivals of performing arts within the scope of the Ministry's authority according to the provisions of law and the decentralization and authorization of the Minister.
- Receive deposits of audio and video recordings containing artistic performance content for commercial purposes from organizations under central agencies according to the provisions of the law. Organize storage for a period of 24 months and carry out purification or liquidation after the expiration of the storage period.
- Check, compare, suspend circulation, and force destruction of deposited audio and video recordings when detecting violations of the law on performing arts and other relevant laws.
- Develop a plan to introduce, promote, exchange, and foster interdisciplinary cooperation in domestic and international performing arts and organize implementation after approval.
- Propose to the Minister to send artists, committees, groups, and art troupes to perform abroad in exchange for international integration programs or participate in international art competitions and festivals.
- Appraise the content and quality of national and international art programs according to the Minister's decision.
- Appraise foreign-funded programs and projects for performing arts and literary activities and organize implementation according to the Minister's decision.
- Organize or coordinate art performance activities according to the decision of the Minister.
- Preside and coordinate with specialized associations and central and local agencies to organize competitions and festivals of various types of professional performing arts according to the decision of the Minister.
- Orient art units nationwide to research, collect, preserve, and promote the traditional artistic values of the nation, absorb the artistic quintessence of countries around the world, and stage and perform for domestic and international audiences.
- Preside and coordinate to organize the implementation of scientific research plans, the application of scientific and technological advances, and the planning and professional training in performing arts.
- Coordinate to develop standards for professional titles for public employees specializing in performing arts.
- Preside and coordinate to organize professional training and fostering programs in the field of performing arts according to the provisions of law and assigned by the Minister.
- Coordinate to develop operating mechanisms of public service organizations, fees, and charges in the field of performing arts, submit to competent authorities for approval, and organize implementation according to regulations.
- Coordinate and appraise dossiers for awarding the Ho Chi Minh Prize and the State Prize for literature and arts; consider and award the titles of People's Artist and Meritorious Artist.
- Assist the Minister in the state management of activities of political - social - professional organizations, socio-professional organizations, performing arts, and literary funds according to the regulations of the Law.
- Regarding literature:
+ Develop and submit to competent authorities mechanisms and policies on literary activities;
+ Instruct on organizing and inspecting literary activities;
+ Assist the Minister in managing the work of composition, critical theory, preservation, introduction, and promotion of literary works according to the provisions of the law; Monitor the training and fostering of young writers and organize literary and artistic creation camps;
+ Coordinate with Literary Associations and relevant agencies, departments, branches, and unions to guide and organize the implementation of literary ordering mechanisms, competitions, and awards;
+ Organize communication activities about literature and art.
- Advise and assist the Minister in directing, guiding, and inspecting expertise and skills in the field of performing arts for the Department of Culture, Sports, and Tourism and the Department of Culture and Sports in accordance with the provisions of law.
- Advise and guide the functions, tasks, powers, and organizational structure of public service units operating in the field of performing arts under the Department of Culture, Sports, and Tourism, Department of Culture and Sports, according to the regulations of the Law.
- Check and coordinate inspections; make recommendations; handle violations; and resolve complaints and denunciations according to the provisions of the law.
- Propose rewards and discipline for units and individuals in performing arts and literary activities according to the provisions of law.
- Implement administrative reform and digital transformation according to the Ministry's programs and plans.
- Manage the organizational structure and civil servants; implement policies and regimes for civil servants and workers under the Department's management according to the provisions of law and decentralization of the Minister.
- Manage and use finances, assets, and other assigned resources according to the provisions of the law.
- Perform other tasks assigned by the Minister and according to the provisions of the law.
