1. Latest requirements for the construction sites in Vietnam

According to Article 109 of the Construction Law 2014, the requirements for construction sites are stipulated as follows:

- The investor is responsible for installing construction project signboards at the construction site, except for individual houses with a scale of less than 7 floors. The content of the signboard includes:

+ Name and scale of the project;

+ Start date and completion date;

+ Name, address, phone number of the investor, construction contractor, construction design organization, and the organization or individual supervising the construction;

+ Perspective drawing of the project.

- The construction contractor is responsible for managing the entire construction site in accordance with the law, except when the investor organizes the management. The content of construction site management includes:

+ The area surrounding the construction site must have a barrier, a guard station, and easily visible signs to ensure separation between the site and the outside;

+ The layout of the construction site must be in accordance with the approved overall construction layout design and the specific conditions of the construction site;

+ Materials, equipment awaiting installation must be neatly arranged according to the overall construction layout design;

+ The construction site must have signboards indicating the general site layout, safety, fire prevention, explosion prevention, and other necessary signs.

- The construction contractor must have measures in place to ensure the safety of people and vehicles entering and leaving the construction site, manage and dispose of construction waste appropriately, and not negatively impact the surrounding environment of the construction site.

2. Rights and obligations of the investor in supervising construction work in Vietnam

The rights and obligations of the investor in supervising construction work according to Article 121 of the Construction Law 2014 are as follows:

- The investor has the following rights:

+ To personally supervise the construction of the project when they have the required capability for construction supervision and take responsibility for their supervision;

+ To negotiate and sign contracts for supervising construction projects; monitor, supervise, and require the contractor supervising the construction to perform in accordance with the signed contract;

+ To change or request the consulting organization to change the supervisor in the event that the supervisor does not perform suitably;

+ To suspend or terminate the construction supervision contract according to the provisions of law;

+ Other rights as provided by the contract and relevant legal provisions.

- The investor has the following obligations:

+ To select a consulting supervisor with the appropriate capability for the type and grade of construction works to sign a construction supervision contract if not personally supervising the construction;

+ To notify relevant parties about the rights and obligations of the consulting supervisor;

+ To promptly handle recommendations from the supervisor;

+ To fully fulfill the obligations agreed upon in the construction supervision contract;

+ To maintain records of construction supervision results;

+ To compensate for damages when selecting a supervision consultant who lacks the capacity to supervise construction, wrongly certifies quantities, incorrect designs, and other violations causing damage due to their actions;

+ Other obligations as provided by the contract and relevant legal provisions.
