1. Which agency does the Non-governmental Organizations Department belong to in Vietnam?

The Department of Non-Governmental Organizations is an organization under the Ministry of Home Affairs, performing the function of advising and assisting the Minister of Home Affairs in state management in the fields of associations, social funds, charity funds, domestic non-governmental organizations (hereinafter referred to as associations, funds, and non-governmental organizations), and Red Cross activities according to the provisions of law.

2. Duties and powers of the Department of Non-Governmental Organizations in Vietnam

The Department of Non-Governmental Organizations advises and assists the Minister of Home Affairs in performing the following tasks and powers:

- Develop law projects, ordinances, and legal documents on the organization and operations of associations, funds, non-governmental organizations, and Red Cross activities as assigned by the Minister and submit them to competent authorities for promulgation.

- Submit to the Minister so that the Minister can submit to the Prime Minister for approval the Charter of nationwide associations with Party and Union assigned tasks by the Party and State.

- Evaluate and submit to the Minister for consideration and decision:

+ Allowing the establishment, division, separation, merger, consolidation, dissolution, renaming, charter approval, and organization of term congresses or extraordinary congresses of associations with a national or inter-provincial scope of operation according to the regulations of the Law;

+ Granting establishment licenses and recognizing fund charter; allowing consolidation, merger, division, separation, dissolution, and renaming of funds; temporary suspension of operations; allowing the fund to resume operations after a temporary suspension; recognizing the fund's eligibility to operate; recognizing members of the Fund Management Council; allowing changes or reissues of establishment licenses; expanding the scope of operations and consolidating and converting funds; revoke the establishment license for funds with a nationwide or inter-provincial scope of operation; the fund has foreign organizations and individuals contributing assets with Vietnamese citizens and organizations to establish and operate within the province.

- Preside over the appraisal or coordinate the appraisal according to the provisions of law of non-refundable aid amounts that are not part of official development assistance from foreign agencies, organizations, and individuals (hereinafter referred to as aid) for associations, social funds, and charity funds according to the provisions of law on management and use of aid for Vietnam, submitted to the Minister for consideration and approval. Annually synthesize the management and use of aid for associations, social funds, and charity funds and send it to the Ministry of Planning and Investment. Help the Minister inspect and supervise according to regulations.

- Submit to the Minister for permission for associations, social funds, and charity funds to organize international conferences and seminars according to their authority. Organize domestic and international conferences and seminars in areas within the Department's functions as assigned by the Minister.

- Chair or coordinate with agencies and units to monitor, guide, and provide professional training on state management work and compliance with the law by citizens, organizations, associations, funds, and non-governmental organizations.

- Coordinate state management of foreign non-governmental organizations; Participate in allowing foreign non-governmental organizations to set up representative offices, issue operating licenses, and perform other activities in Vietnam according to the provisions of law.

- Preside over and coordinate with relevant agencies and organizations to inspect the implementation of the provisions of the law on associations, the implementation of the association's charter, and the implementation of the law on Red Cross activities; Inspect and supervise the organization and operations of social funds and charity funds according to the provisions of the law; Resolve and handle violations of the law and recommendations related to associations, funds, and non-governmental organizations.

- Contribute opinions to ministries, branches, agencies, and organizations related to state management of associations, funds, and non-governmental organizations.

- Lead or participate in research on scientific topics in areas within the Department's functions as assigned by the Minister.

- Summarize and make preliminary reports to the Government and the Prime Minister on a regular or irregular basis on the state management of associations, funds, and non-governmental organizations.

- Preside and coordinate with the Information Center to manage, exploit, and use information databases on associations, funds, and non-governmental organizations; carry out reporting and statistics on associations, social funds, charity funds, and Red Cross activities.

- Preside and coordinate with relevant agencies to propose to the Minister that they consider rewarding organizations and individuals with outstanding achievements according to their authority in the organization and activities of associations, funds, non-governmental organizations, and Red Cross activities.

- Coordinate with units under the Ministry in solving a number of issues related to payroll, recruitment, management, employment, training, and policies for domestic associations, funds, non-governmental organizations and officials, civil servants, and people working at domestic associations, funds, and non-governmental organizations as assigned by the Minister.

- Perform other tasks assigned by the Minister.
