On October 1, 2024, the Minister of Health of Vietnam promulgated Circular No. 19/2024/TT-BYT on the list of imported and exported medical equipment with assigned HS codes under Vietnam’s Nomenclature.
Circular No. 19/2024/TT-BYT promulgates the list and application principles of the list of imported and exported medical equipment with assigned HS codes under Vietnam’s Nomenclature enclosed with Circular No. 31/2022/TT-BTC on the promulgation of Vietnam’s Nomenclature. The application principles of the list are as follows:
- Where there are differences and inconsistencies in the classification and assignment of HS codes to goods in the list enclosed with this Circular, the assignment of HS codes shall comply with customs laws.
- Regarding imported and exported medical equipment that is not included or assigned with HS codes in the list enclosed with this Circular, the assignment of HS codes shall comply with customs laws. After customs clearance, exporting and importing organizations and individuals shall submit documents to the Ministry of Health of Vietnam (through the Infrastructure and Medical Device Administration) to serve as the basis for cooperation with the Ministry of Finance of Vietnam in considering unifying, updating, and promulgating the additional list.
- The list of medical equipment with assigned HS codes enclosed with this Circular shall be the basis for organizations and individuals to export and import medical equipment into Vietnam.
- The list includes goods determined as medical equipment and managed under Decree No. 98/2021/ND-CP on the management of medical equipment amended by Decree No. 07/2023/ND-CP and other legislative documents on medical equipment.
