On December 19, 2024, the Minister of Transport of Vietnam issued Circular 61/2024/TT-BGTVT amending Circular 18/2021/TT-BGTVT on regulations regarding the organization and operation of inland waterway port authority in Vietnam.
Certain provisions of Circular 18/2021/TT-BGTVT on the organization and operation of inland waterway port authorities including the duties and authority of the inland waterway port authorities are amended as follows:
- Inspect the implementation of legal regulations within the boundaries of ports, wharves, and anchorages regarding: safety, security, and environmental protection for vessels, seaplanes, foreign watercraft; certificates of competence, professional certificates for crew members, operators, and crew lists; loading and unloading equipment, certificates, and licenses for operators of loading and unloading equipment as per regulations.
- Issue permission or movement orders for vessels, seaplanes, foreign watercraft entering or leaving ports, wharves, and anchorages as per regulations. Deny entry or exit for vessels, seaplanes, foreign watercraft when the ports, wharves, anchorages, or the vessels, seaplanes, foreign watercraft do not meet safety, security, and environmental protection standards or when the ports, wharves, anchorages do not meet operational conditions as regulated by law.
- Manage channels and routes as assigned by the Minister of Transport; notify the status of channels and routes to vessels, seaplanes, foreign watercraft.
- Confirm inland waterway reports as per legal regulations; execute orders from competent authorities regarding the detention or release of seagoing ships under detention as regulated.
- Inspect and supervise the implementation of inland waterway traffic regulations by organizations and individuals within the scope of responsibility; receive citizens, resolve complaints, denunciations, feedback, and recommendations from organizations and citizens; prevent and combat corruption, misconduct, practice thrift, and oppose waste; impose administrative penalties; collect fees and charges as mandated by law.
