Guidelines on the preliminary assessment of damage to people and property in the event of a fire in the People's Public Security Forces of Vietnam

On November 21, 2024, the Minister of Public Security of Vietnam issued Circular 88/2024/TT-BCA stipulating the assignment of responsibilities, coordination relationships, and procedures for verification and handling of fire incidents within the People's Public Security forces of Vietnam.

The preliminary determination of human and property damage in a fire incident within the People's Public Security of Vietnam is carried out as follows:

- The Fire Prevention and Rescue Police or the Administrative Management Police on Social Order (for district-level police units that have not established a Fire Prevention and Rescue Police) at the district level shall take the lead, coordinating with relevant units to preliminarily determine the damage to humans, property (total value of houses, structures, and assets attached to houses and structures; means of transportation; materials, equipment, and goods burned or other assets with sufficient evidence to prove and determine value) and identify the leading unit for verification and resolution of the fire incident.

The preliminary determination of human and property damage is based on the testimony of the legal owners of the damaged assets, documents on the origin, and duration of use of the assets affected by the fire and other related documents (if any).

- Participants in the preliminary determination of human and property damage include:

+ Representatives from the Investigation Police Department of the district-level police, commune-level police where the fire occurred;

+ The owner of the facility, the household owner, the owner of the means of transport, the legal owner of the damaged property, or the legal representative (if any);

+ Eyewitnesses, persons with related rights and obligations, persons with specialized knowledge (if any);

+ Representatives of the Fire Prevention and Rescue Police Division of the provincial-level police for fires occurring at facilities managed by the provincial-level Fire Prevention and Rescue Police Division;

+ Representatives of the local government where the fire occurred.

- The preliminary determination of human and property damage and the leading unit for verification and resolution of the fire must be documented as per Form No. 01 issued with Circular 88/2024/TT-BCA. If there are differing opinions among the participants on the preliminary determination of human and property damage and the leading unit for verification and resolution of the fire, the leading unit shall decide on the preliminary determination result.
