On December 9, 2024, the Ministry of Natural Resources and Environment of Vietnam issued Decision 3961/QD-BTNMT announcing internal administrative procedures in the field of water resources within the State administrative system under the management functions of the Ministry of Natural Resources and Environment.

Procedures for adjusting the Specialized Technical Planning of Water Resources in Vietnam

* Sequence of implementation:

- Step 1: The Minister of Natural Resources and Environment of Vietnam assigns the Planning Agency to review and adjust the Specialized Technical Planning of Water Resources (overall planning for basic water resource investigation and integrated planning of inter-provincial river basins).

- Step 2: The Ministry of Natural Resources and Environment seeks opinions on the Adjusted Planning Dossier from ministries, ministerial-level agencies, provincial People's Committees, River Basin Organizations (if any), and relevant agencies, units, organizations, and individuals as specified in Clause 2, Article 14 of Decree 53/2024/ND-CP. The Planning Agency finalizes the Adjusted Planning Dossier based on feedback and submits it for planning appraisal.

- Step 3: The Minister of Natural Resources and Environment establishes the Planning Appraisal Council and organizes council meetings.

+ If the planning is approved or approved with modifications by the Appraisal Council, within 30 days from receiving the planning appraisal result report, the Planning Agency is responsible for completing the dossier and sending it to the permanent office of the Appraisal Council for feedback before reporting to the Minister of Natural Resources and Environment for consideration and decision to submit to the Prime Minister for approval;

+ If the planning is not approved by the Appraisal Council, within 90 days from receiving the planning appraisal result report, the Planning Agency is responsible for re-completing the dossier and sending it to the permanent office of the Appraisal Council for the Ministry of Natural Resources and Environment to re-organize the appraisal according to the planning appraisal process.

- Step 4: The Ministry of Natural Resources and Environment submits to the Prime Minister for consideration and approval of the planning adjustment.

- Summary of receptions, explanations of opinions, and a copy of opinions from agencies, organizations, individuals;

- Explanatory report on planning adjustment that has been revised and completed;

- System of diagrams and maps related to planning;

- Other documents (if any);

- For the dossier adjusting integrated planning of inter-provincial river basins, there is an additional Strategic Environmental Assessment Report as stipulated by environmental protection law.
