Guidance on determining violations of inspection and calibration of radiation measuring equipment in Vietnam is notable point specified in Circular 19/2023/TT-BKHCN dated September 20, 2023 guiding the Decree 107/2013/NĐ-CP on sanctions for administrative violations in the field of atomic energy, amended in Decree 126/2021/NĐ-CP issued by the Minister of Science and Technology.
Violations of regulations on inspection and calibration of radiation measurement recording equipment, radiation equipment, and radiotherapy sources are determined as follows:
- Failure to periodically inspect medical diagnostic X-ray equipment as prescribed; Failure to periodically inspect radiotherapy equipment as prescribed is an act of an organization or individual using medical diagnostic X-ray equipment or radiotherapy equipment in violation of the provisions of Clauses 1 and 2. Clause 4, Article 9, Joint Circular 13/2014/TTLT-BKHCN-BYT.
- Failure to calibrate radiation measuring equipment according to regulations is the behavior of organizations and individuals conducting radiation work that must be equipped with radiation measurement recording equipment specified in Point e, Clause 2, Article 5; Point c Clause 2 Article 6; Point b, Point c, Point d Clause 2 Article 8; Point b Clause 2 Article 13 of Decree 142/2020/NĐ-CP when using equipment with one of the following violations:
+ Failure to calibrate radiation measuring equipment before being put into use, after repair, or failing to calibrate annually;
+ Calibration of radiation measurement recording equipment by organizations that are not granted registration for atomic energy application support services regarding the calibration of radiation measurement recording equipment;
+ Radiation measuring equipment has been calibrated but does not meet quality standards or does not comply with specifications according to national technical regulations and recognized international standards specified in Clause 3, Article 11 of Circular 19/2023/TT-BKHCN.
- Acts of using radioactive sources and radiation equipment that do not meet quality requirements for diagnosis and treatment in medical examination and treatment are the behavior of organizations and individuals using radiation equipment and operating radiation equipment to diagnose and treat diseases when the equipment inspection results do not meet the requirements.
