Regulations on Classification and Evaluation Criteria for Architectural Works

Recently, the Government of Vietnam issued Decree 85/2020/ND-CP detailing the Architecture Law 2019, which includes provisions detailing the classification and evaluation criteria for architectural works.

To be specific, the criteria for evaluating architectural works of value are specified in Article 3 of Decree 85/2020/ND-CP as follows:

- Criteria for artistic and landscape value, including the following 4 factors:- Represents a type of architecture, architectural style;- The artistic value of the work itself and the overall space within the premises of the work;- The value associated with the landscape, contributing to the landscape of the urban area, scenic spots, natural landscapes;- Value in terms of construction techniques, technology, and the use of building materials.

- Criteria for historical and cultural value include the following factors:- Represents a historical period;- Associated with the distinctive and typical cultural characteristics of the locality;- Date of construction and the longevity of the work.

Note: The scoring table for evaluating architectural works of value is specified in Appendix I issued with this Decree.

Architectural works of value are divided into 3 types:- Type I when meeting both criteria for artistic and landscape value and criteria for historical and cultural value; the criteria for artistic and landscape value must score 80 points or more;- Type II when meeting both criteria;- Type III when meeting one of the above two criteria.

The provincial-level People's Committee (hereinafter abbreviated to the provincial People's Committee) basing on the above regulations, classifies and decides on measures and funding for the implementation to manage, protect, and promote the values of architectural works.
