On September 25, 2020, the Government of Vietnam promulgated Decree 115/2020/ND-CP stipulating the recruitment, usage, and management of public employees.
Provincial People's Committee Directly Inspects, Examines, and Supervises Public Employees (Illustrative Image)
Article 65 of Decree 115/2020/ND-CP stipulates the duties and powers of the provincial People's Committee in the recruitment, utilization, and management of public employees specifically as follows:
- Management of the quantity, standards, recruitment, and utilization of public employees under its management according to the assignment and decentralization; deciding on the appointment, salary classification for grade I professional titles after obtaining the unanimous opinion of the Ministry of Home Affairs; deciding on regular salary increases, pre-term salary increases for public employees holding grade I professional titles; deciding or decentralizing the decision on the appointment of professional titles, salary classification, salary increase, and excess seniority allowances for public employees holding professional titles from grade II downwards under its management.- Decentralizing the recruitment, utilization, training, and retraining of public employees in public service providers under its management authority.- Deciding on the list of job positions, the structure of public employees according to professional titles, and the number of working people according to the assignment, decentralization, and regulations of the Communist Party and the law.- Organizing exams or reviewing for promotion to grade II professional titles for public employees under its management as guided by the Ministry of Home Affairs and professional title management ministries. Organizing or decentralizing, authorizing the organization of exams or reviews for promotion to grade III and grade IV professional titles for public employees under its management.- Conducting rewards and disciplinary actions for public employees within its authority or proposing competent authorities to reward or discipline following regulations.- Conducting statistics and statistical reports on public employees as prescribed.- Inspecting, examining, and supervising the implementation of legal regulations concerning public employees under its management.- Resolving complaints and denunciations according to decentralization and legal regulations.
