This is a notable content in Decree 115/2020/ND-CP of the Government of Vietnam which stipulates the recruitment, usage, and management of public employees.

To be specific, Article 49 of Decree 115/2020/ND-CP stipulates that when the tenure of a public employee as a manager ends as per regulations, the competent authority or entity must initiate the process of reappointment or extension of the managerial tenure. Article 52 of Decree 115/2020/ND-CP stipulates the procedure to extend the tenure until the retirement age as follows:

- No later than 90 days before the end of the appointment term, the competent authority or entity must issue a notice for the review of the extension of the managerial tenure until the retirement age for the public employee.

- The public employee shall prepare a self-assessment report on the performance of their responsibilities and duties during the appointment term and send it to the head of the competent authority or entity.

- The collective leadership of the unit shall discuss and review: if the public employee maintains good health, reputation, and meets the job requirements, they will conduct a secret ballot to decide on the extension of the managerial tenure until the retirement age.

Note: The personnel proposed for the extended tenure until retirement age must receive more than 50% approval from the entire leadership team; if the approval rate is exactly 50%, the decision is made by the head of the unit, who must also report all differing opinions for the competent authority to review and decide.

The head of the public service provider decides, within their authority, or submits to the competent authority for consideration and decision on the extension of the managerial tenure until the retirement age for the public employee.
