Participation in the Appraisal of Housing-Related Content in the Draft New Decree

This is the highlighted content in the Draft Decree amending and supplementing several articles of Decree 99/2015/ND-CP dated November 20, 2015, of the government detailing and guiding the implementation of several articles of the Housing Law.

Draft Decree Amending and Supplementing Certain Articles of Decree 99/2015/ND-CP stipulates the participation in the appraisal of housing contents when approving the investment policy of housing construction projects as follows:

- Organizations and individuals before preparing investment projects for housing construction under the provisions of Clause 2, Article 17 of the Law on Housing must go through procedures to request approval of investment policy in accordance with investment law.- In cases of housing construction investment using funds stipulated in Clause 3, Article 36 and Clause 1, Article 53 of the Law on Housing, the dossier, order, procedures, and authority to decide on investment policy are implemented according to the provisions of the Law on Public Investment; the presiding appraisal agency must seek the appraisal opinions of the Ministry of Construction regarding housing-related contents for projects using central funds, and seek the appraisal opinions of the Department of Construction where the project is located regarding housing-related contents for projects using local funds.- In cases of housing construction investment not falling under the provisions of Clause 2 of this Article but under the approval authority of the Prime Minister, the presiding appraisal agency must seek the appraisal opinions of the Ministry of Construction regarding housing-related contents before submitting it to the Prime Minister for approval of the investment policy. For projects under the approval authority of the provincial People's Committee, the presiding appraisal agency must seek the appraisal opinions of the Department of Construction regarding housing-related contents before submitting it to the provincial People's Committee for approval of the investment policy in accordance with investment law.
