On September 25, 2020, the Government of Vietnam promulgated Decree 115/2020/ND-CP stipulating the recruitment, usage, and management of public employees.
Ministerial-level authority decides on the appointment of Grade I professional title public employee (Illustrative image)
According to Article 63 of Decree 115/2020/ND-CP, which stipulates the tasks and powers of ministries, ministerial-level agencies, agencies under the Government of Vietnam, organizations established by the Government of Vietnam or the Prime Minister of the Government of Vietnam that are not public service providers, as follows:
- Manage the number, standards, recruitment, and use of public employees under their management scope according to assigned duties and levels; decide on the appointment, salary arrangement of Grade I professional title after obtaining the agreement of the Ministry of Home Affairs; decide on regular salary increases, advanced salary increases ahead of time for public employees holding Grade I professional titles; decide or delegate the decision on the appointment of professional titles, salary arrangements, salary increases, and out-of-quota seniority allowances for public employees holding professional titles from Grade II downward under their management scope.- Decide on the list of job positions, structure of public employees according to professional titles, and the number of employees according to the assignments and divisional levels and regulations of the Communist Party and the law.- Organize examinations or consider promotion to Grade II professional titles for public employees under their management scope following the guidance of the Ministry of Home Affairs and the ministry managing professional titles of public employees specialized in specific sectors.- Organize or delegate, authorize the organization of examinations or consideration for promotion to Grade III, Grade IV professional titles for public employees under their management scope.- Statistics and report statistics on public employees according to regulations.- Resolve complaints and denunciations according to divisions and legal regulations.- Ministries, ministerial-level agencies guide, inspect, supervise the implementation of legal regulations concerning public employees under their management scope.- Agencies under the Government of Vietnam, organizations established by the Government of Vietnam or the Prime Minister of the Government of Vietnam that are not public service providers inspect the implementation of legal regulations concerning public employees under their management scope.
