This is an important content stipulated in the Draft Decree on invoices and documents.
Issuing invoices to buyers when selling goods and providing services (Illustrative Image)
According to Article 4 of the Draft Decree regulating invoices and vouchers, the principles for the creation, management, and use of invoices and vouchers are as follows:
- When selling goods or providing services, sellers must issue invoices to buyers and fill in all required information as stipulated in Article 9 of this Decree. In cases where electronic invoices are used, they must follow the standard data format prescribed by the tax authority as stipulated in Article 11 of this Decree.
- Business establishments under the same accounting unit as prescribed by the Accounting Law must use the invoices of the main establishment.
- Organizations or individuals engaged in business activities must use only one type of invoice when selling goods or providing services.
- Sellers of goods who are enterprises, economic organizations, other organizations, business households, and individuals are authorized to have a third party issue electronic or paper invoices for the sale of goods or provision of services. The third-party issued invoice must still show the name of the selling unit as the authorizing unit. The authorization must be formalized in writing between the authorizing party and the authorized party, detailing all information regarding the authorized invoices (type of invoice, purpose of authorization, duration of authorization, method of payment for authorized invoices) and must be reported to the tax authority (through the electronic invoice service provider). In cases where the authorized invoice is an electronic invoice without the tax authority’s code, the authorized party must transmit the electronic invoice data to the tax authority through the service provider.
