Recently, Thu Ky Luat has received several queries related to the obligations of the militia and self-defense forces with the following content: If someone has served in the militia and self-defense forces, do they still have to perform military service? Regarding this issue, Thu Ky Luat responds as follows:
Law on Military Service 2015 stipulates: Citizens who fall into one of the following categories are recognized as having completed active military service in peacetime:
- Key militia members who have completed their obligation to participate in the militia, including at least 12 months in a regular militia role;- Completed continuous service in the Commune Police for at least 36 months or more;- Officials and public employees, university graduates or higher, who have received training and have been conferred the rank of reserve officer;- Youth who have graduated from university, college, or intermediate level and volunteered to serve in economic-defense units for at least 24 months or more according to a Scheme decided by the Prime Minister of the Government of Vietnam;- Citizens who have served on fishing surveillance vessels for at least 24 months or more.
Thus, key militia members who have completed their obligations, including at least 12 months in a regular militia role, are recognized as having completed military service and are not required to participate in military service anymore.
Apart from this case, other cases that have participated in militia obligations still have to perform military service (unless they are temporarily postponed or exempted from the draft).
