Exploitation of Information on Residents in the Draft New Decree

Draft Decree amending and supplementing certain articles of Decree 137/2015/ND-CP stipulates the extraction of information in the National Database on Population in Article 10 as follows:

- Extraction by written request:

- Organizations and individuals specified in clauses 1 and 3 of Article 8 of this Decree, who need to extract information in the National Database on Population, must send a written request to the managing agency of the National Database on Population as stipulated in Article 9 of this Decree. Within 5 working days from the date of receiving the written request, the managing agency of the National Database on Population has the authority to decide to allow the extraction of information from the National Database on Population.- Citizens who need to extract their own information in the National Database on Population when carrying out administrative procedures must present their Identity Card or Citizen ID card. The administrative procedure-settling agency will immediately provide information to the citizen when resolving administrative procedures. If a citizen requests information about themselves in writing to the managing agency of the National Database on Population, the managing agency of the National Database on Population is responsible for providing information to the citizen immediately upon receiving the request.- In the case where the managing agency of the National Database on Population refuses to provide information about a citizen to an organization or individual, it must respond to the organization or individual within 5 working days from the date of receiving the written request, stating the reasons clearly.

- Extraction via telecommunication services:

- Citizens who need to extract their own information in the National Database on Population via telecommunication services can send a text message or call the hotline determined by the managing agency of the National Database on Population.- The information fields that a citizen can extract from the National Database on Population via telecommunication services include: Given name, middle name, and birth name; date of birth; gender; hometown; permanent residence; temporary residence; current residence; relationship with the householder; given name, middle name, and name of the householder and household members.

- Extraction via the electronic information portal:

- Agencies, organizations, and individuals use the personal identification number provided by the citizen to extract information in the National Database on Population to serve the resolution of administrative procedures, civil transactions via the electronic information portal prescribed by the managing agency of the National Database on Population.- The information fields that citizens can extract in the National Database on Population via the electronic information portal include: Given name, middle name, and birth name; date of birth; gender; hometown; permanent residence; temporary residence; current residence; relationship with the householder; given name, middle name, and name of the householder and household members.
