In Article 6 of the Draft Decree stipulating the conditions for pension eligibility as follows:
*** Regarding the conditions for pension eligibility for employees as stipulated in Clauses 1, 2, and 4, Article 2 of the Law on Social Insurance, they should be implemented according to the provisions of Clause 1, Article 219 of the Labor Code. The work of coal mining in underground mines is regulated in Appendix No. 02 issued with this Decree.
*** Regarding the conditions for pension eligibility for employees who have both a period of compulsory social insurance contribution and a period of voluntary social insurance contribution:
- For employees with a total period of voluntary and compulsory social insurance contribution of 20 years or more, the age condition for pension eligibility is as stipulated in Point c, Clause 1, Article 219 of the Labor Code and Article 3 of this Decree, except for the case stipulated in Point b, Clause 2 of this Decree.- For employees with 20 years or more of compulsory social insurance contribution, the age condition for pension eligibility is as stipulated in Points a, b, Clause 1, Article 219 of the Labor Code and Articles 3, 4 of this Decree.- For female employees who are officials at commune level or non-specialized workers at communes, wards, or commune-level towns who have 15 years to less than 20 years of compulsory social insurance contribution and meet the retirement age stipulated in Clause 2, Article 169 of the Labor Code, and preserve the mandatory social insurance period while continuing to participate in voluntary social insurance, they are entitled to a pension upon request.
