On July 29, 2013, the Ministry of Culture, Sports and Tourism of Vietnam issued Circular 05/2013/TT-BVHTTDL on formulation of Vietnam standards and national technical regulations.
Circular 05: Procedures for formulating the draft Vietnam Standard (Illustrative image)
According to Clause 2, Article 11 of Circular 05/2013/TT-BVHTTDL, the procedures for formulating the draft Vietnam Standard are carried out as follows:
- The Head of the Compilation Organization establishes the Technical Committee (or technical subcommittee) to
+ Formulate the draft Vietnam Standard and is responsible for revising and completing the draft until it is published;
+ Conduct research and draft the national standard according to the content and schedule as planned and approved in the project on formulating the Vietnam Standard; organize conferences and seminars to discuss and provide opinions on the draft Vietnam Standard;
+ Organize the collection of opinions for the draft Vietnam Standard:
Send the draft Vietnam Standard along with the explanatory documents to the relevant agencies, organizations, and individuals, simultaneously announce the collection of opinions on the draft Vietnam Standard with the explanatory documents on the website of the Ministry of Culture, Sports, and Tourism, the website www.tbt-mocst.vn, and the Directorate for Standards, Metrology, and Quality. The explanatory content of the draft Vietnam Standard follows the template specified in Appendix VIII issued with this Circular.
The organization of opinion collection must ensure the participation and opinions of related parties and coordinating agencies (as specified in the project on formulating the Vietnam Standard). The period for collecting opinions on the draft Vietnam Standard shall be at least 60 (sixty) days from the date of sending the draft.
- Organize to compile and process the opinions to complete the draft and explanatory documents of the draft Vietnam Standard;
- Report to the Ministry of Culture, Sports and Tourism (via the Department of Science, Technology, and Environment) on any adjustments regarding: members of the Technical Committee; content, schedule of the plan, and content execution as required;
- Organize foundational assessment and acceptance of the project on formulating Vietnam Standard:
- The Head of the Compilation Organization establishes the Assessment and Acceptance Council for the project on formulating the Vietnam Standard.
- Council members include: representatives of the Compilation Organization, representatives of the Department of Science, Technology, and Environment, representatives of the Directorate for Standards, Metrology, and Quality, and related ministries, central authorities, and organizations in formulating Vietnam Standard, as well as reputable experts inside and outside the Ministry with appropriate expertise and deep knowledge of the national standards group. Members of the Technical Committee cannot be members of the Council.
- Based on the Contract, Explanatory Documents of the project on formulating the Vietnam Standard, and the results evidenced through the comprehensive research report and presentation by the lead individual, the Council evaluates the product quality of the project on formulating Vietnam Standard.
- Complete the draft Vietnam Standard and dossier to send to the Ministry of Culture, Sports, and Tourism for verification.
- The application for appraisal of the draft Vietnam Standard includes:
- Official Dispatch requesting to verify the dossier and the draft Vietnam Standard from the Compilation Organization;
- Decision on the assignment to implement the project on formulating the Vietnam Standard, along with the approved project on formulating the Vietnam Standard;
- Report on the drafting process of the draft Vietnam Standard by the Compilation Organization;
- The completed national standards draft based on opinions from the acceptance of the project on formulating the Vietnam Standard (including both the draft document and electronic file), along with the explanatory document; copies of original documents used as a basis for the draft Vietnam Standard; other reference materials;
- List of agencies, organizations, and individuals who received the draft Vietnam Standard for opinions; consolidated and explanatory responses to opinions, along with the opinions documents.
The opinions content is conducted using the draft Vietnam Standard Assessment Form according to the template specified in Appendix IX issued with this Circular.
- Minutes of the base acceptance of the draft Vietnam Standard project, acceptance opinions documents;
- Other documents related to the opinions processing (if any).
The number of applications is 07 sets.
