Composition of the Advisory Council for the selection of projects on formulating the Vietnam Standard

This important provision is stipulated in Circular 05/2013/TT-BVHTTDL on formulation of national standards and national technical regulations issued by the Ministry of Culture, Sports, and Tourism on July 29, 2013.

Article 9 of Circular 05/2013/TT-BVHTTDL specifies the advisory for the selection of projects on formulating the Vietnam Standard as follows:

Within 15 (fifteen) days from the expiration date for the submission of applications, the Ministry of Culture, Sports, and Tourism of Vietnam shall organize the advisory for the selection of projects on formulating the Vietnam Standard.

The Minister of Culture, Sports, and Tourism decides to establish advisory councils for the selection of projects on formulating the Vietnam Standard (hereinafter referred to as the Advisory Council) upon the recommendation of the Director of the Department of Science, Technology, and Environment for each group of Vietnam Standard subjects.

+ The Advisory Council consists of 07 to 11 members including the Chairman, Vice-Chairman, and other members, comprising:

- Representatives from relevant agencies and units under the Ministry of Culture, Sports, and Tourism related to the construction of Vietnam Standards (representing at least 1/2 of the members of the Council).

- Experts from within or outside the Ministry of Culture, Sports, and Tourism who are reputable, qualified, and deeply knowledgeable about the group of Vietnam Standard subjects.

- Representatives of ministries, central authorities, and organizations related to the field of Vietnam Standard construction.

+ The Secretariat of the Advisory Council consists of members who are specialists from the Department of Science, Technology, and Environment.

- Responsibilities of the Advisory Council:

- Advising on the selection of names, necessity, completeness of legal bases, feasibility, progress of project execution; rationality of budget allocation for project tasks; and organizational capacity of the registration unit for the project execution.

- Ensuring fair, accurate, and objective assessments.

- Bearing individual responsibility for their evaluation results and collective responsibility for the overall conclusions of the Advisory Council.

- Working principles of the Advisory Council:

- Members openly discuss assigned tasks and take responsibility for their opinions.

- Advisory Council meetings must have at least 2/3 of the members present (written opinions of absent members are for reference only).

- The Chairman of the Advisory Council presides over meetings; in the absence of the Chairman, the Vice-Chairman presides over the meeting.

- Content of Advisory Council meetings:

- Members of the Advisory Council review and evaluate the project on formulating the Vietnam Standard according to the Sample Evaluation Form specified in Appendix IV and the Assessment Form in Appendix V issued with this Circular.

- The Advisory Council elects a Vote Counting Committee consisting of 03 (three) members, including 01 (one) Head of the committee. The vote counting results are recorded in a minutes form specified in Appendix VI issued with this Circular.

- project on formulating the Vietnam Standards recommended for execution by the Advisory Council must be approved by at least 2/3 of the members present, and this number of members must not be less than 1/2 of the total members of the Advisory Council.

- The Council discusses, supplements, or amends the contents of the project on formulating the Vietnam Standard recommended for execution by the Advisory Council.

- If no final conclusion can be reached, the Advisory Council will report to the Ministry's leadership for decision.

- The conclusions of the Advisory Council shall be reflected in the meeting minutes as the basis for completing the content of the project on formulating the Vietnam Standard to be submitted to the Ministry's leadership for approval.
