Blasting services in Vietnam from January 1, 2025

According to Article 40 of the Law on management and use of weapons, explosives and combat gears 2024, blasting service is the use of industrial explosives to perform a blasting contract between a blasting service enterprise and an organization or individual in need, including:

- Blasting service within a locality, limited to the mainland of one province or centrally governed city;

- Blasting service on the continental shelf;

- Blasting service with activities across the entire territory of the Socialist Republic of Vietnam.

The quantity, scope, and scale of organization providing blasting services must align with the tasks and needs of construction activities, concentrated mineral activities, and the unique socio-economic conditions of the locality;

In necessary cases to ensure security, order, and social safety, the state management agency of industrial explosives may designate and mandate Blasting services in areas and locations with specific security, order, and social safety characteristics.

Conditions, rights, and obligations of organization providing blasting services in Vietnam

organization providing blasting services shall be established in accordance with legal regulations, registered to engage in the business of providing blasting services; those providing blasting services nationwide must be state enterprises or enterprises with 100% charter capital held by state enterprises;

Additionally, enterprises must meet the conditions for using, storing, and transporting industrial explosives according to the Law on management and use of weapons, explosives and combat gears 2024; possess the necessary physical, technical infrastructure, and personnel to ensure the provision of blasting services for organizations and individuals hiring the service;

organization providing blasting services have the rights and obligations as stipulated by the Law on management and use of weapons, explosives and combat gears 2024 and other relevant legal provisions when using, storing, and transporting industrial explosives to perform blasting services.

Rights and obligations of organization or individual in need of blasting services in Vietnam

According to Clause 3, Article 40 of the Law on management and use of weapons, explosives and combat gears 2024, organization or individual in need of blasting services in Vietnam have the following rights and obligations:

- Not required to obtain a license for the industrial explosive activities for which blasting services have been hired;

- May hire up to 2 enterprises with blasting service licenses to provide one type of blasting service in a region where blasting is required and must define in writing to unify the permissible scope of blasting service use, safe blasting methods between the hiring party and the service provider with the participation of representatives from the local industrial explosives management agency;

- Operate under the guidance of the blasting service provider in specific activities related to storing, transporting, and using industrial explosives;

- Cooperate and facilitate support for the blasting service provider on matters related to security and safety in industrial explosive activities.
